Child born in the UK

Post by Mehreen » Sun Feb 01, 2015 10:18 pm

Hi everyone

Sorry if this is a repeat but I'm new to the forum and am finding it hard to find posts similar to this posted recently.

My husband is on a Tier-2 G visa and I'm his dependant since May 2013.
We have been blessed with a baby girl in September 2014 and intend to go to our home country(India) in March.

We received her Indian passport recently as my husband is eligible to apply for ILR in November this year.

I have two queries:

1- Does my child need a UK dependant visa for going to India or can we apply for it from there when we come back?

2- If we apply for her visa from the UK do we need to show maintenance for all three of us (£2300 approx.)?

And one final query:

My husband can apply for ILR in November but I came here in May 2013...Does that mean I can't apply for ILR with him and have to wait for my 5 years to complete?
And once he gets ILR what will be my visa status? I need to renew my dependant visa next year but its Tier-2 dependant...He will be having ILR??

Sorry if I'm asking too many things altogether.

Thanks.

first, you apply for dependent visa here in the uk before leaving to India, your child automatically eligible for it.
Once your partner gets ILR, you should switch into spouse visa, ( its not compulsory to change there and then but ASAP) and add your child into it as a dependent. You must meet financial requirement for that.
