Spouse visa curtailment. Wife absconded

Spouse visa curtailment. Wife absconded

My wife who arrived on a spouse visa late October 2014 has left me. Came back from work 4 weeks ago and she was gone with all her belongings. I 've since written to the Manchester team. How long does it take them to send me an acknowledgement and will they curtail her visa. There's no evidence of do, but people will teach her to make allegations.

They probably won't.

She'll find it impossible to extend or apply for ILR though, that's when the net will close...

The Manchester team publication States

You must consider curtailing a migrant’s leave granted on the basis of their relationship to a settled person under paragraph 323(ii) of the Immigration Rules, if that relationship has broken down. In this case they no longer meet the requirements of the rules under which they were granted leave to enter or remain. Below are examples of when to consider whether curtailment action may be appropriate following the breakdown of a relationship. When the spouse or partner informs the Home Office of a breakdown A UK settled person contacts the Home Office with information that their spouse or partner, who arrived four months ago with a spouse visa, has left them. As the marriage or partnership no longer exists, and the migrant has outstanding leave, you must consider referring the case for curtailment.

Based on this I reckon they should curtail her visa.

I stand by what I said - mostly they won't bother as it's too much waste of resource tracking someone down etc. They'll just wait for the inevitable application for leave and deport her.

Is it also a case of Domestic violance like many others?

She can't claim domestic violence as she never called the police. I went to work and she moved out before I returned. She could later make allegations but she has no evidence. I reported her missing to the police, they found her but never said anything to me about domestic violence.

Wanderer...... Suppose she meets a settled person and has a child what then?

It shouldn't be an issue if she goes to have a child with another man, it's her body she'll be giving to that man anyway. And certainly nothing stops you from having a child with another woman if you so wish.
What you need to swallow hard is the fact that you've been used by this woman and move on with your life. Desperately looking for ways to destroy her life will likely amount to nothing but cause you more and more stress.
