Do I qualify for ILR? Please help.

Do I qualify for ILR? Please help.

Can anyone please advise me.

My husband came into the country on a student visa in 2001. Always renewed it in time.

He changed to HSMP in 2007. I've always been his dependant since 2007. It was granted from 2007-2009.

We applied for first extension in 2009 but it was refused. We appealed, appeal was refused, we wrote a letter for judicial review and that was also refused. We did not know that appeal rights had been exhausted by then.

We reapplied in 2010 with the missing document and our tier 1 general was extended till 2013.

He applied for 10 years ILR in 2011 but it was refused because we had a gap in 2009/2010 totalling 110 days.

Our first HSMP was granted in 2007. And we have had 1 extension so far. Please can he apply for ILR because he's been on the tier 1 general for 5 years now( including while on section 3c and 3d leave), or should we just apply for a further extension of TIER 1 general?

We will need more precise dates as in day-month-year of the visa grants/expiries/extensions and so forth.

What was the missing document, and why didn't you supply it with the original application or in one of the subsequent appeals? Such things can cloud immigration histories against your favor.

Well that might be accurate, though without some more exact dates as to when visas were granted, expired, applied for, etc... it's hard to tell. And you don't seem to be arguing the grounds of the refusal anyway.

It really depends on the dates. I'd think you very possibly could apply gathering what I can from the information you've provided. But without those dates, it's impossible to give much useful advice with any certainty.

It's going to be difficult to remember the dates because ukba have kept our passports since 2013. I'll try my best

1st HSMP application granted from July 31 2007. It was granted for 2 years till the 31st July 2009,

We extended in July 2009, it was refused because if missing foreign bank statement.
We appealed but we still had not received bank statement by the appeal day. Therefore the appeal was still refused.


We reapplied when we got the bank statement and our visa was changed to Tier 1 general.

It was granted from April 2010 to April 2013


My husband applied for ILR (10 years) in January 2013
It was refused because of a gap in 2009/2010.

He came to the country on a student visa in 2001 December.

a lot of details still missing

what has happaned since 2013? why are you saying home office kept your passports since 2013?

why are you saying he has spend 5 years on tier 1 including 3c and 3d leave? have you filed an appeal against the long residency refusal? trying to figure out where did 3d leave come from

so you have not extended tier 1 at all after 2013, but are still fighting the long residence application refusal?

He applied for 10 years ILR IN January 2013
It was refused in June 2013 with right of appeal
We lodged appeal and appeal hearing date was in March 2014

At the appeal, judge said refusal of 10 years ILR was unlawful that the case should go back to home office for reconsideration;

After so much waiting, home office replied us and still upheld their original decision to refuse ILR because of the gap he had in 2010.

We were also given a right to appeal this lasers decision. We are still waiting for hearing date, but in the mean time, we are considering all other available options.
1. Apply for extension of Tier 1;
2. Does he qualify for tier 1 ILR
3. There's no point going for 10 years lawful ILR anymore because of the gap.
4. He's been in section 3c 3d leave since 2013....

The last refusal of reconsideration was received in November 2014.

but after november you appealed again, right?

so you want to try go for SET(O) claiming leave extended by 3d essentially extended your tier 1 general all the way since 2013?

this is quite unorthodox but to be honest i think it should work, why not?

i certainly heard tell of folks who had trouble with second tier 1 extensions withdrawing appeals and applying for settlement -- but not to much as to know any particular person by name who succeeded, these are all contemplation. however what you are contemplating is essentially the same thing except you were a couple of years short. people also vary tier 1 extension applications to set(o), relying essentially on the same thing -- 3c leave.

of course the rule is you cannot make a fresh application during appeal pending/3d leave, but you can withdraw the appeal and apply within 28 days from that. 28 days still works. people do use 3c and 3d leave to make up ten years for 10-year ILR all the time, and that does get granted. they withdraw pending appeals and then apply.

no reason really this should not work in your case.

the total best case would be to apply to ILR at PEO in sheffield, and in case it fails immediately apply for tier 1 extension. i remember someone on these boards managed to do that, they went to sheffield and demanded basically that their passports from another pending case file were brought down -- and eventually they were. but i think that case might have been a variation of a postal application to another one at peo.
since you are in appeals process we don't even know if your passports ARE in sheffield.

so the whole thing will probably have to happen by post and take even more time to sort out, but i thin chances are pretty good. and certainly better than they are at you ever succeeding at the 10-year thing with the gap you had.

the set(o) case would have to be airtight though, perfect (but for the background, on which you can fight if you have to, but nothing in the rules prohibits that)

that being said, A NEW CAVEAT - you must take into account that since in order to file the application you'd have to withdraw the appeal, ending your 3d leave, you will at that moment voluntarily become an overstayer, and remain an overstayer until your ILR application is decided. under the new guidance on good character requirement for naturalisation, you may prejudice yourself against being granted british citizenship possibly for up to 10 years . this may or may not matter to you of course, depending on your original nationality and other factors
