decision overturned but no passport after 3 weeks

Salaam to all.
My husbands appeal was recently overturned and we got notive that the appeal was withdrawn.my husband submitted his passport on 22nd of January, they informed my husband that we would get it back within 15 to 20 days.
Its been three weeks now.
I emailed them and they've said because theres no appeal they cannot trace the passport, like really.
I emailed again today being more stern and demanded they trace his passport as they withdrew the appeal thus its their responsibility to do so.

Any advice as to what to do next, it would be greatly appreciated. Or has anyone been in the same position, please share your experience, PLEASE!

Hello,

Although I do not have legal background I would like to be of help if I can in any way - I am however sure more experienced members would soon comment on the post.

I believe if nothing, you can benefit from the Freedom of Information Act (FOI). In summary, it gives members of the public the right to access recorded information held by public sector organisations; in your case the Home Office.

On this basis alone, I believe they should give information on how they "keep record" of the passports held with them. Which of course in turn would help raise the question of how they are not able to "trace" a passport.

But who do I ask for this information.
Is there anyone specific to call.
I did call the first tier appeal tribunals, but they said because the appeal has been withdrawn they couldn't help me because there is no longer an appeal in place for them to trace.
Its become really annoying.

Im planning to call my MP so he can call the embassy for me.

Have you tried contacting the UK Visas and Immigration contact centre?

They are not the best at advising on specific laws as in answering case specific questions, but they should be able to escalate your query and/or provide you with the right contact number.

I believe there is also a specific set of contact details to use following a decision on tribunal; I will need to look that up though.

You may need to hold the line for a rather long time over the phone - I have waited over 30-40 mins on few occasions.

It would also be handy if you had the Home Office Reference number nearby to quote.
