Hi
I’m applying for ILR in November 2015 along with my wife and two kids and have below queries;
Tier 1 Main Applicant
I was granted Tier 1 visa on 13 November 2010 and entered into UK on 24 January 2011 (after 72 days). My continuous period in UK has been as follows;
year Visa year start Visa year end Days outside UK
1 12-Nov-14 to 13-Nov-15 --- 74
2 12-Nov-13 to 11-Nov-14 --- 101
3 12-Nov-12 to 11-Nov-13 ---- 25
4 12-Nov-11 to 11-Nov-12 --- 0
5 12-Nov-10 to 11-Nov-11 --- 16
Total days outside UK --- 216
1- Am I under the continuous period?
2- My first entry in UK was after 72 days, is it okay?
Tier 1 – Dependent (Spouse)
My wife got her Tier 1 stamped on 26 June 2011 and entered into UK on 16th July 2011 (after 20 days). Her period of stay in UK has been as follows;
year Visa year start Visa year end Days outside UK
1 26-Jun-14 to 25-Jun-15 --- 207
2 26-Jun-13 to 25-Jun-14 --- 115
3 26-Jun-12 to 25-Jun-13 --- 48
4 26-Jun-11 to 25-Jun-12 --- -
Total days outside UK --- 370
3- Overall she has spent more then 2 years in UK. Considering the above days outside UK she has a break in her stay. For dependent is it to be continuous period (I don’t see anywhere in rules about the stay of dependent being continuous)?
Tier 1 – Dependent (Child 1)
My 1st child born in UK on 12 of July 2012 but left UK 6 May 2014 and will return back in 1st week of April 2015
4- When I will apply for my ILR in November 2015 what will my child be eligible for (ILR, Citizenship or dependent visa)?
Tier 1 – Dependent (Child 2)
My 2nd child born outside UK on 18th December 2014 and will come to UK on 3rd April 2015.
5- When I will apply for my ILR in November 2015 what will my child be eligible for (ILR, Citizenship or dependent visa)?
Hope to hear soon from you guys. Many thanks in advance.
