Tier 1 General - ILR - New Fee - Question and Advise - Help!

Post by Haneef » Sat Feb 21, 2015 11:40 pm

Hello Friends,

Hope you are all doing good.

I have a couple of simple and straight-forward questions about the new fee which is going to be effective from 6th Apr 2015 and my ILR in relation to it.

I have been in the UK for close to 5 years now and my HSMP visa issued in India in 2010 (Tier 1 General Migrant) is coming to expiry on 7th May 2015. As the fee for ILR is increasing from 6th April 2015 and one cannot apply for ILR more than 28 days before actual expiry of Visa, I would like to know whether I will pay the current fee of £1093 or the revised fee of £1500 (coming into effect from 6th Apr). Please help me with your suggestions and opinions on how and what can possibly done to stay in the old fee; if at all. Coz this increase is huge and ridiculous to say the least.

Also, my wife joined me last year in Jan as a Dependent. Her visa too expires on the same date as mine i.e. 7th May 2015. I would like one year that she spent with me in UK be taken into account when she applies for Extension. Otherwise, if I am compelled to switch the category to FLR(M), then she will lose the year she has spent on dependent visa.

Once again, I really appreciate any advise given and would like to thank in advance everyone who throws light on my case.

Note:
I have a full-time job that meets the earning criteria and have cleared the Life in the UK test too.

The fees will depend on how and when you apply.

See also FAQ and dependants.

When were you granted a visa in 2010?
When did you arrive?
