family of a settled person visa,

Hi,
Currently iam in ILR visa. My wife was in Tier 1 Dependany visa. Her visa expired on 4/Feb/2015. Currently she is living outiside UK. I want to apply dependant visa for my wife and my daughter. Kindly let me know your suggestion.

Do i need to apply dependant visa for my wife and my daugther under Tier1(General) Dependant category or under family of a settled person category. When i login in to the site "http://www.vfsglobal.co.uk/India/how_to_apply.html", for 'family of a settled person' category it shows Settlement->Settlement->Wife, Settlement->Settlement->Child, is it right option for 'family of a settled person' visa category ?

Do you meet the financial requirements under Appendix FM? That is, for a spouse + 1 child (gross annual income of £22,400 or more per year)?

Then you need settlement visa, that of a spouse who is settled. Looks like the right options.

Thanks a lot for your reply. I was reading the DEP_guidance_07_14.pdf form. I got confused with the below statement.

You can apply as a PBS Dependant if you meet the criteria set out in this guidance and the
Immigration Rules, and you are:
the spouse or partner of a person with indefinite leave to remain or British Citizenship who last
held leave in Tier 1, 2, or 5 of the Points Based System and you do not yet qualify for indefinite
leave to remain; or

Kindly let me know your comments.

Hi there..can somebody help..I am applying on behalf of my son and am here in the UK..my son is below 18.. I cannot somehow proceed to step two on the online application as it wants to know the details of my sons father and I have got no details as I choose to be a single parent......I cannot be entering fictitious names and dates and wouldn't want to risk turned down either..I have emailed UK immigration but so far I am not convinced of what they say that I have to fill it up..it's not clear at all..Thanks.

First time it was refsued becaused i did not submit the following document
1) CT600
2) unaudited account
3) Company appoinment report
4) business bank statement

I submitted all the above document. Second time they refused saying
1) Company registration with company house
2) VAT registration certificate
3) VAT returns for last full finance year.

My doubt is should i go for appeal or should i submit fresh application. What will be success percentage if i go for appeal. Please let me know your suggestion.

That is a crazy basis of refusal. You should appeal. Coz they may use relationship next time round.

Applying for visas is just a case of ticking all the boxes and they then get the visas. Self employeds require lots of documents but they are all listed clearly with what you need. All they refused you on is what you were required to show.

Have a read of the requirements for self employed and make sure you proivide all the documents and do everying. i.e. paying your taxes early if you are using that tax year to sponsor, as the visa requires that. Note that UKVI use the money you declare to HMRC to be taxed on to meet the financial requirement, not the amount you show before you use your tax allowances to reduce the amount you pay taxes on.

It's all clearly listed. Just follow the guidelines, tick all the boxes and they will get the visas.
