Hi,

I have had my ILR 6 years ago and i didn't apply for my passport back then. I have been out of the country for less than 2 years and I am back to the UK and I would like to know if i have to stay 3 years then apply for the British Passport or is it 1 year then apply for it as my spouse is British?

As spouse of British Citizen, you need to be within the absence limits, which are as follows :

No more than 270 days absence in the 3 years immediately before your application and you must have been physically present in the UK on the same date 3 years before.

No more than 90 days absence in the last 12 months before you apply.

You will also need to meet the English Level B1 test and Life in the UK (if not already done).
