Hi there,

What will be the status of a child born outside uk while his father hold ILR in UK and is in the process of getting british passport through naturalisation? I heard that if a child born outside UK to a parent who are british by otherwise than descend then child will automitcally become british by descent..if that is the case then why british father need financial requirements when he apply visa for their dependents when they can bevome british automatically?

If the baby is born BEFORE you become British then the child is not British by descent if born abroad and you would need to meet the financial requirement.

If child is born in the UK after you get ILR, then the child is automatically British.

If the baby is born AFTER you become British, this is the date of your ceremony, then the child is automatically British by descent and can apply for passport. You don't need to include the child in the financial requirement.

Thank you CR001 for reply. So ILR become irrelevant if child is born outside UK. I have seen that many people hold british nationality but still try to bring their dependent (wife and kids under 18) in uk after fulfilling financial requirements instead of getting nationality for kids outside UK. Is it because they dont want their kids become british by descent but through naturalisation?

It depends on whether the home country allows dual nationality and how long it takes to get a British passport from home country or RoA or CoE for a child born abroad to a British parent.

A British Citizen by descent can still pass on the nationality if they have a child born in the UK.

If a child is British by descent (born abroad for example to a parent who is British otherwise than by descent). That child is British whether the parents wish to admit to it or not. A child cannot renounce their citizenship of the UK.
