Status of child born outside UK to a British Parent

Post by ramblin rose » Wed Feb 25, 2015 6:54 pm

Hi there, hope you can help

My daughter is british through naturalisation, she got married in Tanzania to a local man, and has recently had a baby. Tanzania allow dual nationality. My daughter wants to come to UK for a visit, and has applied for Tanzanian passport for baby. But website says you cannot apply for a visa to visit UK if you are entitled to british citizenship. So I think baby will be british by descent, and we should apply for registration in the normal way ( I know that if we make the wrong application we won't get the money back!)
Please can you tell me if this is correct? many thanks

You are wrong. A baby born abroad AFTER your daughter naturalised as a British Citizen, the baby is British by descent and can apply for a British passport.

Thank you so much. Could you perhaps answer another question please? should my daughter's passport be in her married name before she applies for the baby's passport - it has a good five years to run still so she hasn't applied to change it yet.........?

Should not be an issue. She could use her marriage certificate and the childs birth certificate to link the names.

Passport applications from abroad can take many weeks though as all are processed in the UK.

That's very helpful, thank you! Sorry to ask again but do you know if she can just apply for the baby's UK passport without having to apply for British citizenship? Should she register the childs birth in the uk?

The child is automatically British by descent if she was British Otherwise than Descent at the time of the birth.

If she wants to, she can register the childs birth at the British Embassy/High Commission in Tanzania, ideally within 12 months of the birth.
