British pass port for the child born in Greece

British pass port for the child born in Greece

Hi All,
I hold ILR (just applied for it and will definitely get it), i married a Greek national and we are planning to have our child delivered in athens in august. since i hold ILR , would it be possible for the baby to have british passport , how can i go about applying for it??

I need to know this as the baby may need a passport to fly into UK after the birth.

Your child will only be British if s/he is born in the UK while you have ILR.

If s/he is born abroad, you will first need to apply for registration under Section 3(1) using Form MN. That is a registration at the discretion of the Home Office, not an entitlement.

However, while both the UK and Greece are part of the EU, the child can travel to the UK on its Greek passport.

Thanks alot for the reply, really appreciate it, would i be able to apply for British passport when the baby will come here? if so how long can i wait please?

No, you will need to register the child on MN1 under section 3(1) of the nationality. This is a decision by discretion, not an entitlement. Cost of this application at the present moment (fees go up in April) is £669, not refundable if application is refused.

There may or may not be a requirement for residence and BC registration will likely only be possible IF one of the parents becomes or applies for British Citizenship given that the child was/will be born abroad.

If you are so eager for the child to have a British passport, simplest thing would be to have the baby born in the UK as baby will then automatically be British and can apply for a passport directly.

My question is i am planning at apply for the british citizen ship in 1 year's time, once i get the british passport, when would i be able to apply for the child to have british passport??

You cannot have his British Passport immediately. As vinny and CR001 wrote, you need to register your child as British Citizen first.
After your child is British, only then you can apply for child's British Passport.
Being British is a state of mind.
