Can anyone who has successfully got their visa confirm that the SU07/12 form and the VAF4A form are not required to submit?
Is my understanding correct that the VAF4A form is done online and the confirmation is printed and submitted along with Appendix 2 which is filled in by hand, and that SU07 form is not relevant for the spouse visa application?
You do not need to fill in the SU07. It is not required for a spouse visa. VAF4A you complete online and Appendix you fill in by hand.
TIMELINE

Spouse Visa (Entry Clearance) granted on 20-02-15
FLR-M (Extension) granted on 24-08-17
ILR (SET-M) not due until 2020

Hi mayo99

What do you mean tax for just 6 months !? You cant pay tax for just 6 months. As when you send your visa application off , they check with hmrc how much tax you have paid they dont just check if tax was paid for 6 months unless you have only been working six months, but still after you submit your application you still need to working and paying tax because they do check. For example if you put in your application in the start of january - you need show evidence of the past 6 months which is july to december. They will check you tax record from june to february. Or if you only started working in july then july to february. Point being they check beyond the 6 months. To answer your question you would pay in a year £2080 income tax and £1553 national insurance. This is just rough estimate of £3633.00 a year for 6 months £1816.50.

I put in an appeal as i was assured by 2-3 solicitors that if the system is updated and letters from HMRC prove this then it would be overturned by a ECM. How ever that has not happened even with HMRC providing letters that its not my fault that the system was not updating itself and confirmed my upto date income. I ask on what basis would an ECM still refuse the appeal? Also what is the best step to take now?

Salaam what evidence did you include from hmrc to show it was a system update error , because the RTI system introduced in 2013 and this has caused some what of controversy. What other evidence did you include in your appeal ?
Hi fari, the evidence i submitted with my wifes appeal were a letter from my employers accountant stating that ive been a employee for almost a year now but most importantly 2 letters from HMRC. 1 confirming im still employed by the same company and that due to transmission issues between HMRC employers unit and the accountant that they could not give exact information on taxes paid as well as well as exact amounts paid to me. 2 a letter from HMRC stating my paye records are uptodate as of december 2014 and also reciepts of taxes paid by my employer along with bank statements for another 6 months showing that pay is regularly coming in.

Okay thats fine, inshalah with that info you should get the visa and hopefully in the review process while eco has got the evidence hopefully they can overturn that decision inshalah. Did u write a letter to explain that its not your fault your taxes are not paid. They have been deducted from you wage! Which you have as proof ! Its not your responsibility to make sure taxes are paid. The best thing an applicant could do before submitting their visa application is get an employment history of all the tax paid to date. It would make your case a lot stronger. Inshalah you should get it overturned soon inshalah. Just a lot of dua inshalah and faith in allah swt. If it is meant to be it will be if not then then we should realise that this is for our own good. Remember me in your duaas inshalah.

Hey gucci
I would say atleast 3-4 weeks later, plus they dont really check with the employer any more as they can get all their employment history from hmrc. Xx

Hi guys I am back.

So here is my timeline...

Online Application: 15th Sept 2014
Biometrics: 19th Sept 2014
Visa rejected: 27th Jan 2015
Submission of 2nd online application: 23rd Feb 2015
Biometrics: 2nd March 2015

So here's my question

My TB certificate expires on 4th March 2015.
As you can see above I submitted my online and biometrics just days before the expiry. Will that be a problem with the ECO?

Yes they can also check your paid salary. Iv seen a friends of mine refusal letter, on there it stated the salary for past years too like how much her spouse had earned. Her spouse didn't pay tax on the 6th months and after the case was submitted he came pakistan to see his wife. For 2 months. Because tax wasn't paid on those months. They rejected it. However won an appeal later in court after they explained he was on unpaid leave ! They paid tax for the 6th month, a letter from hmrc to confirm it also a employer letter. Hope that answers his ur questions. Xx

Hey

it should be okay, however they could tell you to do another one before they accept your visa. You may have to email it to them. They they would accept your case taking it account everything else was okay. Iv seen this been done in the past with people who may not have submitted land registry documents. What was your refusal reason for your first application ?

The Land Registry document is an option, not a required document. Whereas the TB test certificate is a required document. But since there are still a few days remaining prior to submitting the application, he/she might get away with it. However, I would have told my spouse to get it done again, especially if one is reapplying after a rejection. Shouldn't take any chances of getting refused.

CNIC is not a requirement,if u want to submit cnic ,its better u have ur name on ur wife cnic.
They just need proof of marriage in different types, like
Nikkah nama,photos,communication,etc

ielts minimum scores/bands ,they required 4.
Listening n speaking,
Reading n writing is not considered for spouse visa,

Last year I did ielts with a score overall 5 ,
I got refusal on other grounds, they didn't write anything about my English test.
My bank statement was differ from my payslips.

If u were earning 22000 before tax ,its more then enough,
But make sure u were earn same amount every month, bcuz they use to calculate the lesser amount u have to earn.

I applied for the first time in june 2013, it went on hold in sept 2013. We presented 12 months payslips n calculated pay for 12 months but the pay for last 6 months was calculated to be less than 18600 pounds (it was 18400 pounds). Hence we withdrew the case n reapplied in jan 2014 on cat A and D. In sept 2014 it got refused. Our savings were not counted as they didnt approve our property selling documents etc. now we have a daughter too. We intend to apply in august 2015. Now there would b two applications but we confused whether two sets of original documents will be required?
