Hi Friends,

Thank you for the good job all are doing here. I hope some senior members will help me.

I am due to apply for BC and thinking of booking through NCS.

In July 2013, I got FIXED PENALTY (SP50, 3 Points and £60 fine). Then in August 2014, I unfortunatly got CCJ on my name. I couldnt go to court because i was badly wounded by a dog and was too weak to anything. The police was involved, but decided not press charges to the dog owner. The judge sentence against me and got CCJ and i couldn't attend the court hearing.

I have arrange with the credit card company paying monthly instalment. Then In Feb 2015, I got a letter from the court stating

" Upon reading a letter from the Claimant, IT IS ORDERED THAT The Attachment of Earnings Application is Adjourned Generally with Liberty to Restore at the Request of Either Party".

Hmmmm, Will all this affect my citizenship application under good character? I got ILR through 10years long stay. No police or any disorder.

Any help on my case will be appreciated from all members.

I am looking for information if someone of you could kindly tell me as i am too worried. I have already applied for British Naturalization two months ago and still in process.
My Question is i was refused "Leave to Remain" in October 2010 based on 320(7)B Deception and asked to leave the country. I appealed but refused than i appealed to Upper Tribunal but decided to withdraw my application and leave country Voluntarily in Feb 2011. I got married in my home country to a British Citizen and applied for Spouse Visa which was granted and came to UK again in December 2011. Then i got ILR in November 2013 and have applied of naturalization in January 2015.

My Question is that is my application likely to refuse based on 320 (7)b in 2010? Since i applied for spouse and ILR after that and had no problem. I believe i did not overstay in country because i withdraw my appeal from upper tribunal and left country. I would appreciate if someone could reply according to Rules. Thank you.

If you have overstayed you your application will most likely be refused.

I am so frustrated with HO right now, I just need to vent it out. Years we have waited to get my husband's citizenship, we are just about ready to send it off so I come back to this forum to check things out again and they've bloody changed it again!!!!!

We've waited 7 years for his 20 day custodial sentence to clear and now we have to wait for another three years to get to ten!!!! I'm so annoyed for trying to do things properly. he should have just sent it off back in 2010 and not bothered declaring anything. So many people he knows got citizenship back then without declaring any convictions. It's absolutely ridiculous that he tries to do the right thing and they just make it even harder.

Well I think you should be grateful that they even allow someone who's been to prison to apply for British Citizenship! It's only fair enough they have to wait, and are not in the same level as someone who's been honest his entire life!

I understand what you are trying to say but life is never black and white. It's just a shame that there are people out there who genuinely do have extremely bad character, but they are lucky enough not to have received a prison sentence. So they can carry on being an unsavoury character but apply for citizenship unhindered. There are so many obstacles for people rehabilitating their lives after prison. And I'm not just talking about immigration, I mean for any ex-offender to be back to normal life. But I digress, that's not an issue for this forum.

Even a mistaken/false arrest can ruin ur career forever as it will stay on ur file/crb for 100 years.

Can someone help me in regards to naturalisation application. Does HO contact to companies house regarding applicant whether at some point he/she being director. In case nothing mentioned on application form. And what kind of check HO does if known please.

If you overstayed than you have to wait 10 years.

Deception could be an issue. But u never know they might consider

Subject: KNOWLEDGE OF LANGUAGE AND QUALIFICATION REQUIREMENT.

I have a quick enquiry about the naturalisation application (AN) where one of the criteria under section 1 (1.2) of Knowledgeoflanguage/lifeintheUK:

✔ I have a speaking and listening qualification in English at B1 CEFR or higher, or an equivalent level qualification; OR

✔ I have obtained an academic qualification deemed by UK NARIC to meet the recognised standard of a Bachelor’s or Master’s degree or PhD in the United Kingdom and:
(i) UK NARIC has confirmed that the qualification was taught or researched in English; or
(ii) the qualification was taught or researched in the UK or a majority English speaking country(other than Canada); OR

✔ I am a national of a majority English speaking country; OR

✔ I met the knowledge of language and life requirement to qualify for settlement on or after 28th October 2013; OR

✔ I wish to claim exemption on the basis of my physical or mental condition (physical and/or mental illness
may not lead automatically to exemption. You should provide reasons on page 15. Your application may fail
and the fee retained if insufficient reasons for exemption are provided).

My Question to you is I have my IELTS certificate taken in 2006 in India,for previous Immigration purposes.Will this be valid for speaking and listening Qualification in English B1 CEFR or higher.
I also have a Post Graduate Diploma in Business Administration from Sheffield Hallam University will this be accepted as a qualification taught in English.

And further regarding my wife's Qualification, she has a Bachelors degree from India which on Point Based Calculator gets her 20 Points for qualification and 10 points for degree taught in English Language. So can I submit evidence from the on-line points calculator, together with the original degree certificate, to demonstrate that my wife can satisfy the English language element of the Knowledge of Language in the UK requirement or do I still need to obtain confirmation from UK NARIC that the qualification was taught or researched in English by requesting an English Language Assessment (ELA) and also request a Statement of Comparability.

If someone could please revert back to me will be highly appreciated.

I sent my application in and now I realised that I have a caution that I completely forgot about and didn't mention anywhere in the form. The police caution was given to me sometime in 2010, what do you suggest is best course of action , to call and disclose the information, send an mail, request return of documents, consult a lawyer or anything else?

Perhaps someone had the similar experience?

Write and declare the caution, send via recorded delivery with your acknowledgment reference. As 3 years has lapsed you should be ok. Pop into the police station with ID, ask for the basic details of the caution, date is was given and what it was for, do it today and send in details today.

I filed my case for naturlization last month but I did not declare my fpn which was driving holding mobile phone happened in 2007.

Can some one please tell me if I should have declared it and if yes then what can I do now ?

Just to confirm it was not in court . Just on road By police.

You should be ok as you didn't need to declare it.

Hi All,

I would like to know if i need to declare the below fpn scenario?

I did receive some letters from bailiff in December 2013 stated that I owe them 700 pounds as I did not pay my penalty to Ealing council. I did contact to Ealing council and explained them that they have been sending all paper work to my old address so therefore they should waive all the charges and send me new fpn (pcn) to my new address but they refused and advised me to contact TEC which i did and filled a N244 form. I received a letter from TEC that my case has been forward to court long story short Judge ordered the Ealing council that they should stop the bailiff and re-issue the ticket and give me rights to challenge the original ticket. I did not challenge as I did park on loading bay at 9:30pm as i wasn’t aware that time so I paid original ticket fee to Ealing which was around 60 pounds something. Everything was sorted in May 2014.

Now my question is that I went to court and challenged the bailiff and found not guilty. Do I need to mention this in my application?
Also I had 3 points in my licence back in Feb 2008 due to taking wrong turn in Central London and police gave me 3 points and fined me on spot. Since then I didn’t have any points and its all cleared now.

sorry forgot to mention that it did happed twice.

First time i paid to bailiff (back in 2010 ticket issued from Hounslow Council) but 2nd time i challanged them as both time ticket was issued during move to one house to other. First time i wasnt aware of any law which could stop bailiff so i paid them as they were harrassing.

Please let me know if i need to mention these two scenario

Sorry I hadn't read the new guide. Yeah according to that guide you need to disclose it. Write a letter to HO explaining the mistake and declare it. Mention your application reference number if any. Make sure you send recorded delivery and keep a copy of the letter.

Address u find on ur acknowledgement letter. Put the reference number from there as well.
