ELDELRY DEPENDENT FOR PARENTS

I AM FRM MALAYSIA AND HAVE AN INDEFINITE LEAVE TO REMAIN . MY MOTHER IS 65 AND MY DAD IS 59 BOTH RETIRED . I HAVE ONLY ONE YOUNGER BROTHER IN MALAYSIA . BOTH MY PARENTS HAVE BEEN
DEPENDENT ON ME FINANCIALLY AS I AM WORKING AS A DOCTOR IN UK.
I HAVE BEEN SENDING MONEY ANNUALLY AND KEPT THE RECEIPTS.
I HAVE APPLIED FOR MY PARENTS FOR SETTLEMENT VISA AS THEY ARE DEPENDENT ON ME BUT THIS HAVE BEEN REFUSED. WE ARE WAITING FOR APPEAL , ANY FURHTER ADVICE ??

Think you need to give more information, particularly the reasons given for refusal. Then maybe we can advise.

The reason for refusal was my only brother is still in malaysia . my parents do not depend on him financially as i have to even loan him some money so he pays me every month therefore will not be able to support my parents . the other reason was my parents siblings are in malaysia although all of them are elderly and retired depending on their own children . the other reason was the money i send home goes to a joint account between me and my mum . and they are quering that there are some regular small amount of transaction occurring every month so a source of income (this transactions are for me frm my investments) my parents do not have any pensions. only asset is their home.

The UK Visas website - www.ukvisas.gov.uk gives the following criteria that has to be met for relatives to get settlement in UK:

Can parents, grandparents and other dependent relatives go to live in the UK?
If you are a widowed parent or grandparent aged 65 or over, or parents or grandparents travelling together and one of you is 65 or over, you may qualify if:

* you are completely or mainly financially dependent on children or grandchildren living and settled in the UK
* you have no other close relatives in your own country to help you
* your children or grandchildren can support you without needing help from public funds, and
* your children or grandchildren have enough accommodation, which they alone own or live in, where you can live without needing any help from public funds.

If you are a parent or grandparent under the age of 65, you may qualify if:

* you are living in the most exceptional compassionate circumstances
* you are completely or mainly financially dependent on children or grandchildren living and settled in the UK
* you have no other close relatives in your own country to help you
* your children or grandchildren can support you without needing help from public funds, and
* your children or grandchildren have enough accommodation, which they alone own or live in, where you can live without needing any help from public funds.

So you need to provide more evidence to support these points. If you did not receive an Appeal Notice, then u can reapply. Make sure you get letters from other family members confirming they do not support your parents in any way, and outlining their circumstances. Also give proof of the investments that are going into your joint account. You already have proof of your income and will need also to provide details of the accommodation you have available. Basically, provide as much evidence as you can to meet all of the points relevant to them above.

what is an appeal notice ?? we have sent a AIT2 form with futher evidence of bank statement and also letter frm my parents sibling and also frm my brother that they are dependent on me . also i have included receipt of loan to my brother to his account . the ECO in malaysia si still refusing despite this evidence and the appeal now is going to uk .

The Appeal Notice is the AIT2 form and it sounds like you have sent all evidence. I am not sure what referring it back to UK means - there are other Advisors on this site that could give you more specific information and would suggest that you do a search and look for their contact details....maybe Victoria could help you??

TO be honest, the chances aren't good if they are both under 65. Someone's posted the immigration rules, and as you can see, it's not just about finances.

Then the first set of rules above would apply as one of them is 65 or over.
This may make it slightly easier than if they were both below 65.
You just have to be sure you prove each of the points as shown with sufficient evidence.
As you appear to have done this and they have still not accepted then you have to wait for the Appeal to take place.
You can go through this procedure yourself or contact one of the experts on this site for assistance. It may be worth paying for expert help if it really is essential for them to be with you.

As it is, I have nothing to contribute to this thread. I totally agree with Amanda, and I think that they will be hard pushed to win this appeal with a son still in Malaysia.
