Financial requirement for FLR - when are children dependent?

Post by matt1020 » Tue Mar 31, 2015 11:42 am

Hi, I'm relatively new at this so apologies if this in the wrong section.

I'm a British citizen and my wife's here on a spouse visa (Family life as a partner – 5 year route), which is dependent on us meeting the new financial requirements.

We are thinking of starting the family within the next year or so and whilst my employment (just over £20,000) met the initial requirement for her visa to come to the UK, it would be insufficient to meet the requirement for one child in addition to partner of £22,400 per annum. (Unless I get a generous pay rise in the meantime - unlikely!)

However, if our child is born in the UK then he/she would automatically be a British citizen so do they actually need to be included in the test to meet the financial requirement for an application of extension of my wife's visa? I have read all the information pertaining to this including FLR(M) guidance notes and I'm still unclear, so many thanks in advance for any assistance.

Matt.

That's correct. The extra Financial requirements for child (E-ECP.3.1, E-LTRP.3.1) are not applicable to a British child.
