Double Descent ?

Post by michael11 » Thu Apr 02, 2015 8:31 pm

Both Grandparents on my Father's side were born in England. I guess that can get me the 5 year permit, but can I just apply for British Citizenship outright? My Father was born in Canada, and this is where I live as well.
Thanks

It is highly unlikely that you are a British citizen by descent.

British citizenship (and I believe Canadian citizenship as well) can only be passed on to one generation born overseas. As your grandparents were born in the UK, your father, though born in Canada, was also a British citizen by descent. However, a British citizen by descent can not pass on his citizenship to his children, unless they were born in the UK.

These are the broad principles of current UK citizenship law.

To help you further, can you provide us with your father's and grandparents year of birth? And were your grandparents married at the time of your father's birth? Similarly, were your parents married at the time of your birth? UK citizenship law has evolved over time and the questions above are to look at if older provisions of the law may apply.

You are, as you mentioned, eligible for the Ancestry visa based on the citizenship of your grandparents.

Thanks for the reply. I just realized that I have a 3rd Grandparent that was born in London England. Not that it matters..

As far as the Visa goes, does it complicate things if I bring my Canadian born wife and son? (son is 8 years old)

Thanks!

No, UK Ancestry visa permits dependants.
