I am absolutely clueless!! i have no idea whats going on! anyone who has had a similar experience? or can any1 help me who i should contact? coz when i call the British High commission the automated telephone operator says the the BHC no longer deals with visa matters!!!
Its been 1year 4 months and i am still waiting!! more than 4 months ive won the appeal! why havent i heard from anyone?? any1 knows any number i can call to get an update??

Any help will be appreciated :(
Hey best to get in touch with your MP, they will contact Home office on your behalf. As you know MPs are currently powerless due to election but when its over do go over and speak to them. Unfortunately a reply from home office can take more than 2 months via your MP. :cry:

Salaam,

Have a quick question ....
Does anyone have any knowledge of applying under financial exemption route (adequate maintenance)?

I'm currently receiving disability living allowance £104.10 per week which is £416.40 per month
Employment and support allowance (support group) £186.90 per week which is £747.60 per month
The rent for my flat is covered by housing benefit fully £80 per week benefit.

Is the above more than enough to satisfy their requirements ??

Has anyone recently applied using the exemption and if so what was the outcome??

I'm looking to submit my wife's application in few days time so would appreciate the feedback.

Documents submitting ...

Cover letter from lawyer to state rules and law for exemption
Sponsors statement
Translated nikkah form plus original
Benefit letters from dwp and council
Dr letter and report
Bank statements
Housing report and tenancy with letter form.landlord
Call logs
Previous travel docs like boarding cards
Wedding photos
Attested passport copy

Is there anything else I need to send from my side to my wife for her application? ?

Visa was refused..as last pay slip didn't reflect in the bank statements and cash savings were not declared as to who gave me the gifts... Inshallah will be appealing and sending in the bank statement reflecting the last slip and declaration of all savings

Also it says in appeal form that u need to appeal on grounds of human Rights act..does anyone have any advisw? Would be aq great help

Definitely if its just docs they require then send it for a review, they could refuse the review aswell and then u have to appeal but its quicker this way u find out within 28 days

The guy at the vfs office told my hubby u can review this which is quicker - am just waiting for my solicitor to contact me i will pm u as soon as i find out - i think its done online u pay a fee then take all docs plus supporting docs back and submit it - but just waiting on clarification on this xxx

Ok let me know please also how much is the fee? If I send it for a review won't they say at the time of application u didnt provide the last bank statement and declaration of savings

And also if I file an appeal..under which human Rights act should I apply? HELP please

I think human right appeal would be if kids were involved i have a son who is 4 months but they wrote at the bottom of the refusal letter that according to my decision a child in the uk will not be affected

My son is 16 months they also wrote the same but my son is with his dad now he has got so attached to him..what grounds should I apply under then?

Very unfortunate. Appeals can take anything from several months to a year or so.

But please for your own sake, don't use the family friend you've been relying on always. These school boy mistakes shouldn't be made if your solicitor is qualified in immigration law. If he isn't then you shouldn't be turning to him in the first place. To be honest, you don't even need a law degree to make a successful settlement visa application.

Take my advice, submit the appeal yourself.

A fresh application for spouse visa, will probably be the quickest option.

Don't worry I won't be using that dickhead again...I will be consulting a proper lawyer and doing it myself all I need to add is the January bank statement and declaration of savings... Also What grounds of law should I apply under

You were refused because your application was incomplete.

Now you are asking them to reconsider providing the missing documents.

I don't think stillwaiting123 qualifies for a review as the refusal is based on lack of evidence (going by what stillwaiting123 has said) and not as a result of the ECO's own mistake.

It was today based on payslips as i had a change of pay as i was promoted at work - hopefully gonna get a letter from work to show eco was wrong and go for a review

Oh ok I see. Hope it all goes well inshallah. i don't understand what the issue is as long as you earn over the threshold and the payslips match the bank statements one would think it would be fine..

Are you filling form IAFT-2?

Which page is that on?

I can only see ticky box for "Type of Decision" (Settlement)

and

"D. Grounds of your appeal

• You must let us know in the box below the reasons why you disagree with the decision on the Notice of Decision document.
• Include any information that has not been mentioned in the Notice of Decision and say whether you have raised these issues before.
• You must give as much detail as possible as you may not be allowed to mention any further grounds at a later date. Attach any evidence / additional sheets of paper if necessary."

Where did you get this form from? Your case isn't about human rights. IAFT-2 is the form you need.
