I applied for Tier 2 (General) spouse visa on 13th of Jan 2014.... i received my passport on 7th Feb, my visa was rejected on the grounds of not showing a 90 days bank statement.. well which wasn't our fault.. it was the bank's (Barclays, UK)mistake, they provided us a bank statement of 87 days... we appealed against our decision as we were not even once contacted by the UKVI to resend the document or anything... our hearing was on 26th Nov, 2014. We won the case. The first tribunal gave the decision in our favor and gave 28 days to UKVI if they wanted to appeal against the decision or otherwise reimburse us the court fee. The fee was transferred to our account which apparently meant that the UKVI didn't have any objection with the decision. Now its been more than 4 months i havent heard from anyone. Complete silence. I have been emailing UKVI, British high Commission Islamabad... and God knows who... but i have not as yet got any update regarding the status of my application. After about 10 emails to "customer service @hmcts.gsi.gov.uk", the only reply ive got is that they can not assist me with my inquiry as my case is out of their jurisdiction and i need to contact the relevant embassy directly!
I am absolutely clueless!! i have no idea whats going on! anyone who has had a similar experience? or can any1 help me who i should contact? coz when i call the British High commission the automated telephone operator says the the BHC no longer deals with visa matters!!!
Its been 1year 4 months and i am still waiting!! more than 4 months ive won the appeal! why havent i heard from anyone?? any1 knows any number i can call to get an update??

Any help will be appreciated :(
Hey best to get in touch with your MP, they will contact Home office on your behalf. As you know MPs are currently powerless due to election but when its over do go over and speak to them. Unfortunately a reply from home office can take more than 2 months via your MP.

thankkkk uuu humbleguy 4 replying... but guess what :( my husband contacted the local MP.. n yes thats exactly the problem @ "currently powerless coz of elections" :( the problem is that the Home Office is saying that my case is not in their jurisdiction and that i should chase the British embassy Islamabad :( ive tried everything..from calling them...emailing them..but they don't respond :( dont know what to do :( infact the first tribunal replied to my email sayin that the BHC should have contacted me within 12 weeks of the decision... they too are sayin that i need to directly contact BHC... don't understand wht the BHC is upto...its contempt of court!! 19weeks!! :( :( what was the point of winning the appeal :( after this i'd advice everyone NEVER appeal..just re-apply!! :(

No probs.

Have you made up your mind to appeal the decision? A new application, will be quicker, unless you don't mind the wait anymore.

Good luck,

No I reckon I should appeal as they are very minor points..I don't want to apply again to be rejected of something else... I've waited 2 years what's a few more months plus I've been in pak for a month now so I should be Ok for while..and doing a new case I've got to get all paper work again and pay the new fee its just too long

Have a quick question ....
Does anyone have any knowledge of applying under financial exemption route (adequate maintenance)?

I'm currently receiving disability living allowance £104.10 per week which is £416.40 per month
Employment and support allowance (support group) £186.90 per week which is £747.60 per month
The rent for my flat is covered by housing benefit fully £80 per week benefit.

Is the above more than enough to satisfy their requirements ??

Has anyone recently applied using the exemption and if so what was the outcome??

I'm looking to submit my wife's application in few days time so would appreciate the feedback.

Documents submitting ...

Cover letter from lawyer to state rules and law for exemption
Sponsors statement
Translated nikkah form plus original
Benefit letters from dwp and council
Dr letter and report
Bank statements
Housing report and tenancy with letter form.landlord
Call logs
Previous travel docs like boarding cards
Wedding photos
Attested passport copy

Is there anything else I need to send from my side to my wife for her application? ?
ANYONE??? p.s I have just submitted my wifes online visa application
may Allah swt give everyone here good news in shaa Allah

If this means, you're not going to be submitting 6 payslips, then you may well be risking another refusal even if the amount is showing on the statement. After two refusals already, why are you willing to take any chances?

You might be right and it may not be an issue. But I personally wouldn't take such chances.

Assalamuallaikum All.

Hope all is well.

I have been following this thread for a while - and I really want you guys to get your visas

Please sign up to a forum like expat forum - Britain UK visa - they give you proper information.

There are not enough people properly helping here - and others not giving correct advice

There is NO ONE WAY to make an application - it is different for every person - there are some standard things to give in - but the rest - you have to see what applies to you etc

Join Expat forum - in the Britain Visa section.

Thanks.

They have 19 weeks to review, if they uphold their decision, your case will then go to court.

Some people are talking about reviews but you can only get a review if u think Eco has made a mistake and the proof correct info was submitted also u get that if appeal has not been offered

I will be appealing in the next week odd..does anyone know what happens once u have sent off appeal form..I will be doing a paper hearing... Does anyone know how long it roughly takes for an outcome..?

You should read up on other peoples experiences on various forums including this one. Appeals are never a quick process. Sometimes even if the decision is made in your favour, the Home Office can appeal the decision in an attempt to overturn it again. Meaning an appeal decision to grant you the visa can be appealed as well and turn it back to a refusal.

I think appeal is best as I have a very strong case and putting on another case could result in refusal with another stupid reason

There is no such thing as review in its entirity, its appeal. When yu do submit the appeal ECO gets given an option to change his/her decision within a given time scale, this is referred to as "review" and if the decision is not overturned by the specified time than the appeal goes into tribunal.

If yu have a latest payment shown in yur bank statement from your employer it sbould be backed by a payslip, otherwise eco will say yu are missing a payslip.

@stillwaiting123

Also take into account the other individual's bank statement who gifted you the cash because am sure the eco will want to know were the other party got the money from. Show their bank statement when money was transferred. Good luck. I hope you succeed in your appeal inshallah.
