MN1 application - Born outside uk

Post by BCappReading » Sun Apr 26, 2015 10:34 am

Hi,

I am applying for my British Citizenship next week along with my son who is 17 years old.

My case is straight forward i.e 5 year residence --> ILR (granted in 2012) + 3 yrs

My son is 17 yrs old and was born outside UK. we got his ILR (as my dependent) in Feb 2013. He entered UK for the first time in Oct 2013 but had to return to india to complete last year of GCSE equivalent. He returned to the UK to settle he permanently in Aug 2014 and has been living and studying here in the UK since then. My question is - he has 303 days absence since his first entry into UK. is there a residency requirement for child applying for Citizenship under section 3(1)?

Would appreciate if you can help.

The child should live in UK for at least two years as far as I know (section 9.17.19 onwards). Also, age 17 and over is leaving you with very short time now, so I'd hurry up and book NCS.
Being British is a state of mind.
