good character confusion

Post by 14years » Wed Apr 29, 2015 1:04 pm

I received my naturalisation in December 2013. I never had any criminal conviction or anything but I have now come to know some thing which I did before December 2013 and never knew it would be a criminal offence. Now there is a chance I may get convicted for that offence. Home office is aware of this. I just needed to ask if the home office can revoke or nullify my naturalisation based on something which I did before 2013 but convicted in
2015?

Many Thanks in advance

I am not an expert in criminal matters so cannot comment much. But personally I wouldn't worry about something that has not happened yet. And since you were not convicted before the Naturalisation. Your oath of sincerity during application and the reason that you have not been convicted till the time you wrote this message, is proof you were truthful in your application.

Whatever happens next, should not affect your current status. I'd however await further replies/post in the link I gave above.

It can be revoked in certain circumstances, details of the offence and background may help.

It is a little complicated but I ll try to explain. I was a stateless when I applied for ILR and naturalisation. But basses of my application was 14 years long residence in the UK. Um it's a bit embarrassing but I guess I have to tell to get a better advice from board members. I paid a girl mate of mine to have sexual intercourse and didn't realise it is against the law to pay some one under 21. She was 19 at that time. As I said home office is aware of it now and it's making me very nervous. Any advice would be much appreciated.

Seniors can tell better as I am not an expert on sexual offences.

Here is what I think. Since she was over the age of 18 hence not a child, so most serious offence is avoided in my view. Most probably it will be a charge of a sexual offence and you will be treated as such and most probably be cautioned and fined and may not be deprived. But I'd await senior's reply and strongly request to seek professional help.

I don't think that it's an offence, if she was over 18. Has the law been changed?

Thanks for guidance vinny.

From your link:
It is illegal to pay for sex with a person under the age of 18, or a person who has been forced into prostitution.
Its the underlined part in which police will be interested. If there is insufficient proof of that then he may have nothing to worry about.

It is an offence unfortunately for me. You can't pay any one unless they are over 21. Police is looking to charge me and home office is aware. If it came to that I am intending to plead guilty. My only concern is that home office can argue the offence happened before I applied for naturalisation hence I am not a man of good character. And they may argue that had they known it at the time of my application they would not have granted me naturalisation. My problem is I genuinely didn't know that it was an offence hence I didn't mention anything to them.

I am going to speak to a solicitor but I would any help or opinion from board members.

Under what legislation/section is it an offence?
What's the charge?
