Naturalisation as an Unmarried Partner of a British Citizen

Post by yadisa » Fri May 01, 2015 6:49 pm

Hi all,

I have been reading some posts here and I thought I should post my question if anyone can help with the right answer.
I got my ILR after the 2yrs probationary periods as an unmarried partner of a british citizen in June 2013 but as it stands we have been separated and not living together for about 3months now. We never got around to getting married and I want to make my application for naturalisation. I have asked him for his passport and other documents but he won't give it me just to spite me. I am wondering could I make the application on my own? Do I still need his passport since in the form they asked for partner or spouse passport.
I am in a mess here and I need help on this.
Thank you all

You don't need his passport etc. It would only be needed if you were married and applying on the basis of being a Spouse of a British Citizen.

You can apply for naturalisation in your own right once you have completed 5 years residence.

Thanks CR001 for your reply.
I came to the UK as a student and completed one year on student visa, then got a post study work visa for another 2years and Unmarried partner visa for another 2yrs and 1 years on ILR. That make a total of 6yrs.
Would that qualify me as been completed the 5years residence requirement?

Your response is greatly appreciated

Yes, if your absences are within the limits.

As Vinny has advised, you can apply in your own right based on 5 years residence (any legal visa status counts) and make sure you are within the absence limits and that you were physically present exactly 5 years ago, to the day, on the date that HO receives your application.

Hi all,

I had a look through the paperwork yesterday to apply for naturalisation on the grounds of having been on an unmarried spouse visa since Feb 2012, ILR since Feb 2014 and now want to apply for citizenship seeign as I have satisfied the three year mark for unmarried spouse basis (2012-15). The thing is i noticed only evidence being required for married and civil partnerships - we have no evidence of this nature obviously and so I wanted to know:

Can i still do the application on the 3 year basis?
I have been in the country without leave of more than 2 months since November 2005 (working holiday/ student/post grad/unmarried/ILR visas respectively)

or am i over thinking this and I could do the application on the grounds of 5 years unbroken here regardless of the nature of the visas and therefore not really reliant on evidence of our relationship?

I noticed that this board is advising that the type of visa is not the requirement,it's more the duration - as long as you have been here without a long absence ? Should i take it that i'm good to go?

We are pretty confused right now and want to get this done, so any assistance would be great,

The Boogooeses

As you are not the spouse, nor a civil partner, of a British citizen, you have to satisfy the 5-year requirements.
