Naturalisation Pl Helpppp..

Post by ansahuss » Fri Apr 24, 2015 11:06 pm

Hi,
my husband is British Citizen , and I'am on ILR, I've just completed 12 months after getting ILR ,
But I was out of country for 7 months in India for medical treatment purpose,
so the rule says you don't have to stay for more than 90 days in 12 months, but since my stay in India is justifiable as I can provide all the medical treatment
So am I still eligible for naturalisation as long I support all treatment documentation,
any help much appreciated.
Thanks

IMHO, while I appreciate your genuine reasons and respect so, it may be a no go from HO' perspective. Sorry if this disappoints

Will it be a big deal to wait 4 months to bring your absence down to roughly 90 days? The risk of losing the fee if you are refused is your choice.

Hi, Appreciate for the reply, I can't wait for very long, and need to go back to India as I have to continue my treatment, as there is a long waiting list in NHS ..

No way around it unfortunately. Besides, applications can take months, there are people still waiting from the first half of last year.

If you have to wait a long time on the NHS for treatment, then it most probably is not a life threatening or urgent illness as the NHS has a strict policy on short waiting times in these circumstances. Long waiting times would be applicable if it is non life threatening, non urgent or elective.

You will need to wait until your absences are within the limit for citizenship as already advised.

Hi , Thanks for the prompt response, but it clearly says on the HO website Total number of absences that may be disregarded if you

b) the absence is justified by Crown service or by compelling
occupational or compassionate reasons taking account of the criteria
at section 5A1.
180 days +
Please note: Only in the most exceptional circumstances would total absences exceeding 180
days in the final 12 months of the qualifying period be disregarded if all other requirements
were not met

Appreciate if some one can explain what is the most exceptional circumstances.

Thanks

This will most likely be a refusal.

But, if you'd like to risk spending £1005 then you can apply and send a cover letter explaining all the situation, and requesting a discretion. Please click here to book for Nationality Checking Service, who will give you your original documents back for quick travel abroad. But please note you need to provide Biometric Information, so please do not make any plans before Home Office has sent a letter for Biometric information and you have provided those.
Being British is a state of mind.
