British Passport for children born in the uk with a german

Hi there, i am a bit lost and its all a bit confusing for me but my question is, i have got twins that have been born 2003 in uk with a british father, i am german and we are not married, they have got a british birth certificate, are they entitled to a british passport? I also have another daughter born in germany from the same dad and has been living in the uk since 2000 with a german birth certificate, would she be entitled to a british passport or would she have to be registered as a british citizen first? Please any help would be appreciated so much, or maybe put me in the right direction

You need to register all of them using form F. None of them is automatically British as they were born before 2006 and you were not married to the British father.

Just to confirm; was their British father British otherwise than by descent (i.e. born in the UK or naturalised as a British Citizen)? This will be important when trying to register your daughter who was not born in the UK.

If your children were not automatically British for the sole reason that you never married their British father, then they may register as British citizens directly.

Could i as the mother not being british apply for my childrens citizen ship or does their father would have to do that?

I believe you can lodge the application for registration but you will need to provide proof of paternity (birth certificate is sufficient if the father was added within 12 months of the child's birth, otherwise more evidence such as a DNA test may be required) and proof of the father's British Citizenship (e.g. passport).

Hi there, thanks again for your help just double checking, wht about the twins that have been born in the uk with a british birth certificate? Would i have to register them as a british citizen first or could i apply for a passport straight away?

Unfortunately, all of your children need to be registered as British Citizens first.
This is due to the fact that prior to 1st July 2006, children born to unmarried parents could not derive British Citizenship from the father.
As this requirement was clearly discriminatory towards children born out of wedlock, the law changed this year and those children can now be registered as British Citizens.

The difference in birth places of your children will have the following effect once you have registered them:

Your daughter (as born outside of the UK) will be British by descent which means she cannot pass her citizenship to any of her children born outside the UK. However, should she have children born outside the UK, these can be registered as British provided certain requirements are met.

Your twins (as born in the UK) will be 'British otherwise than by descent' which means they will be able to pass their citizenship to any children born abroad.
