ILR Holder - expecting a baby

Dear Forum Users,

I am an ILR permit holder. My wife is my dependant and has still got around 3 years to become an ILR.

My first child is a British National now.

A very general question. If God Forbid something happens to me.

1) My wife is expecting our second child. Will he be straightaway elligible to register for British Nationality.

2) What will be status of my wife visa. Will she be able to apply for ILR on basis on being a mother of a British National child.

1) if baby is born in the UK, then baby will automatically be British.

2) Same Status. No.

Please see Page 22 on this link for details. Personally I see the case will be stronger on compassionate grounds since she will also be mother of a British National. Also see page 3 on SET(O) guide.

EDIT: But I see vinny replied already so please see his reply.

Thank you very much for your replies guys. I am confused why Vinny said No?

From Page 22 I can see she should still be able to apply as Bereaved Partner of ILR holder even if not so as a mother of British National. Atleast that gives me a little peace of mind.

Another small think I wanted to ask was. Do I have to register my 2nd child on MN1 form or can directly apply for his British Passpport without any registiration.

If you are still alive on the day child is born, you can apply for Passport straightaway.
