Hi everyone

February Applicants please help me!! Did you get a decision letter when you received your documents with your visa? This letter should say the address of the Post Office from where you should collect my BRP card. Remember BRP card rules started to apply from March 2015.

URGENT!

Thanks

Salaam guys please help.
I have contacted a solicitor regarding attestation n he has suggested that i pay an initial consultation fee of £85 and then after a fee of £900 for the attestation of my documents. I am unaware about the importance of attestation, and who else can attest my documents. I wish to apply myself and not via a solicitor.
I do not understand why is he demanding so much money.

The solicitor is seriously ripping you off for those fees
You can get a whole case complete for under 500 quid
That's including filling in online form and appendix.

You can get your documents Attested from any notary authority be it the local council or like I did myself a advice/community centre... Aslong as they can stamp it and put the correct wording as read this is a true copy of the original ..... that is sufficient.

What i would also recommend is contact your local advice centres and see which offer free immigration advice.. there are some located in every city.

The documents are straight forward tbh... yes you just need some originals attesting such as British passport but other than such there rest go with the paperwork as originals.
There isn't alot a solicitor does other than rip ppl off for something that can be done yourself .

Oh and one more question.. What is the template for the landlord's letter. What are the main things that are needed to be included apart from the tenancy agreement.

You live in rented accommodation? ? If so you also need an inspection report and this to doesn't cost much I paid 25 pounds to local advice centre .

The letter from landlord needs to state the following:
Your full name and address
their full name and address

The date the tenancy started and how long the tenancy is for

the amount you pay per week or month and if all bills are included that should be stated.

Needs to advise that they are happy for your partner to come and reside in the property under the same terms in place.

Remember there should be atleast 6 months left on current agreement.

Also should say that the property shall not become overcrowded and that you and your partner can stay for however long you wish the tenancy being able to be extended before term ends

Don't forget to attach current tenancy agreement with the letter including the inspection report you would require.

Brilliant... Thanks a lot sajjad. I am aware about the survey report but again i was quoted £175. So i can just go to my local advice centre for that too? I was under the impression it had had to be done by healthy abode. But thanks i now knw what to include in my landlords letter.
So for accomodation a survey report, tenancy agreement and landlord's confirmation letter is all i need to fulfill this requirement right?

Yes aadi90 that's everything's
I recommend you visit oisc.gov.uk
It has all the lawyers on there registered for law and choose free immigration advice in options
You will be surprised with the amount of advice centres that deal with immigration in your area
best it is free :)
Remember if your advice centre don't do the report they will recommend someone they deal with and it shouldn't be much at all cause it's just a piece of paper with measurements of the rooms you occupy yourselves including Spam and lounge if applicable.

Do you have the slip that gerrys gave you when you submitted the application? ? If so keep this to hand as this will help you put you case forward

2nd I would wait the 5 dsys if you still don't hear anything then would raise a complaint. .. when you submitted Gerrys would have copied all your documents for they're own records so in worst case the ECO would ask gerrys to forward those docs and in Shaa Allah process yours as though it had been with them from your initial date which should mean that your file wouldn't be thrown at the bottom waiting for assessment.

In Shaa Allah pray that such doesn't happen and that they find your file and that they just forgot to update system.

I have tracked the status (GWFXXXXX and date of birth
00/00/0000) and found that there are no current updates. This could be
because your application was submitted recently or the details that you

Just check your email one more time and double check the gwf number and date if birth they wrote on their reponse back..
Just incase there was a typing error when the request was sent.
But since you have submitted back in March and getting such an email other than an error then yes it does seem there is a problem with their systems.

Hi, my spouse visa has been refused today on bases of 320(11).
Can any one please help me to tell how long an appeal will take to decide ?

Just looked at reference for refusals for refusal under 320 (11)

paragraph 320(11) of the Immigration Rules and provides that:

'where the applicant has previously contrived in a significant way to frustrate the intentions of the Rules by:

(i) overstaying; or

(ii) breaching a condition attached to his leave; or

(iii) being an illegal entrant; or

(iv) using deception in an application for entry clearance, leave to enter or
remain or in order to obtain documents from the Secretary of State or a third party required in support of the application (whether successful or not); and
there are other aggravating circumstances, such as absconding, not meeting

temporary admission/reporting restrictions or bail conditions, using an assumed identity or multiple identities, switching nationality, making frivolous applications or not complying with the redocumentation process.'

There are essentially three parts to this rule which must apply before your application can be refused

Appeal time frame looking at current stats is roughly 6 months until a hearing date.

I would suggest appealing from the UK and pleading your case infront of a judge and depending on which of the top 3 was the cause chances can be good if you can put your case forth strong with any evidence for reasons.
If you apply again most likely will be refused again so best go for appeal and keep faith in Allah SWT.

Appeals are time consuming yes but that's the best chances under spouse entry.
It falls under a discretionary ban which means it's decision makers decision based on whatever info he had of history and it's not an outright ban so don't worry.

JUST APPEAL WITHIN 30 DAYS

Hamza.123 i got that reply twice, one on the 8th and the other on the 13th may. The exact same email, so i thought ill let my time frame pass before i request a further update.

I honestly think you have nothing to worry about in Shaa Allah they should open your file soon and give you a responce. I got my responce on the 21st May, so you shouldnt be too far off.

May Allah make this difficult time easy for you and in Shaa Allah for all the brothers and sisters in this Forum. "Indeed Allah is with those who are patient" - Duas are with you brother

Hi Zaid

On what basis did they refuse under 320(11)?

Refusal under 320(11) is a discretionary ground for refusal so can be appealed against.

Salaam people..
I have a query, i receive my wages on the 5th of every month and my bank statements are dated 4th-3rd every month. My 6th and last wage slip will be ready by August 5th and so will be my wages that will be credited into my account. However, my bank statement that will show my wage's transaction will not be issued until 4th September (& by the time i will receive it in the post it will be the 9th/10th Sept). How do i overcome this situation because u need to apply within 28 days of the 6th wage slip and bank statement.

Walaykum asalaam

There is one way around this situation as I had the same problem also. You can request a copy at branch which they would issue there and then for you.
They will need to stamp the copy to show it's genuine and that's about that really. Get it for a day after the wage is credited to your account and also if you want write a cover letter if you wish for the eco to say you get statements through post but due to timescale this last statement you had to get from branch as the statement needs to be within 28 days
If you want like some people have done already is ask the branch to type you a letter to attach with the statement to stay it is a true statement and the date.
Signed by whoever is authorised to do so at the branch.
do tell the cashier so they are aware as some banks are hesitant doing such as like they say they are very busy.
