english language requirement paragraph 320 (7a)

Post by mj8 » Fri May 22, 2015 5:14 pm

hi everyone,
I need some help please. I overstayed while in the UK and managed to finish a university degree without valid ID [paspport or Visa]. Now ive returned ti my home country to apply for a spousal visa. Is it possible for the ECO to reject my application under paragraph 320 7a and claim that my degree is a false document because i obtained the qualification without showing ID?

You can't be refused under 370(7a) when applying for a spouse visa. 320(11) refers to 'Frustrating the Immigration Rules' but as you won't be using your degree for immigration purposes and didn't submit false ID, I can't see that this would result in a refusal. You might like to read through 320(11)

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
