So what are the option and any good lawyer??

Because it's not a ban and only a discretionary refusal it means that there are chances to overturn the decision as long as you can put forward a good case and reasons... the barrister would be able to comment further into this. Even if you put the case across as breach of human rights as you have kids which can help the decision go in your favour.

Make sure you speak to a few lawyers as one mistake by any lawyer can lead to another refusal.

Also just thought it may be worth mentioning have you ever thort of using the surrinder Singh route eea family permit like going Ireland for a few months?? As this would make it harder for them to refuse you wife entry with the 5 year permit she could get going to Ireland for a few months. You have to show your using treaty rights in Ireland presuming your British.

I would also suggest join expat forums
It's a forum that have plenty of moderators who are specialist in legal immigration and best off all its like this forum free help and advice and also people who have had same issues would be able to guide you.

also in our previous app we submitted almost same documents and thts why eco didn't raise any objection on any of the doc listed below accept salary. so i think all these doc are fine now?? just need to fix just one mistake eco pointed out.

Are you referring to theirpak birth certificate?
If so then it's not really required .. they just need to bring their pakistan I.D card

Also speak to a few lawyers as this can help alot.
You can get free advice by going to any community advice centre that had an immigration drop in session.
Visit oisc.gov.uk for details of local centres practicing law.

If I could ask you why haven't you applied for British citizen ship ?

There is no harm in doing so :)
Though unfortunately they are lagging behind since March on processing
This could be due to alot more applications as everyone is now more aware that April is the month for rule changes esp because now there the daft health surcharge

Going to apply this week or next week.
Just need to clear some things..

1) I understand you submit your original passport (applicant) but do you need to submit NICOP too? If so should you submit the original or an attested copy?

2) From all my reading around is it correct to say copies of applications are no longer needed.
3)Are treasury tags the best way of binding everything?
4)Is there a choice on where you can apply between or is it the closest to your home (e.g between isalamabad and lahore)? Is one faster at processing then the other?

To you first question ...
You need to send a copy of your Pakistani I.D Card and it doesn't need to be Attested but on the day take the original also as they would just want to take a look.

To your second question ...
You need to take a file with orginal which will be forwarded to the BHC and copies of everything for the VFC record they do this so incase something goes missing or any issues the file for reference is readily available.
Make sure you do so otherwise they will charge extortionate price at the VFC to copy everything and just causes delay on the day.

Question 3....
best not to use tags as they pull everything apart anyway to arrange in the order they need to so it's easier for the eco to go through. Just use paperclips to hold documents together.

Question 4...
You do get the option to choose where you would like to submit once you submit the online Vaf4a form but personally I think it's best to submit to nearest as if there are any issues you ain't wasting a journey.
all processing times are roughly the same as they are processed at isb bhc. They are currently meeting their within 12 weeks target and only if there are delays on checks coming back are they taking longer but this is only in a handful of cases.

just heard thhat supreme court accepted to listen hearing regarding 18600 which was in pending. but don't know right now when it will hear & when the results will come. just feeling scared that if court hear n announce results in coming July ( like last year they announce in july n all the application process was delayed for so many months) this time will also delay processing application??? :(

I just saw your post. Where is the source of this information?

If true this will delay everyone's case! Last year my friends case was delayed by 1.5 years because of this! :(

Why did you apply for visit visa instead of spouse visa?

Can I ask what documents you provided? I am thinking about applying for visit visa too if spouse was rejected

The ECO returns all the documents back to VFC with the passport once everything has been processed.
