dependent of tier2 general applying on FLR(m) on ILR sponsor

Post by zgokool » Wed May 27, 2015 5:07 pm

HI there, hope one of the mods would help my query.

married with sponsor on Oct 2013. Got dependent on tier 2 general until 14 November 2015. sponsor got ILR since 2 may 2015.
1.should I apply for extension now on FLR(M) or wait till I have completed 2 years with my sponsor?
2. on the FLR (M) correspondence requirements, I have;
sponsor: G.P letter, NHS letter, bank current account, DVLA, P60
joint: joint savings account
dependent: Bank current account, telephone statements, water bill, DVLA, P60
would that be fine to match the requirements from oct 2013 to june 2015?
3. Also living with sponsor's parents, will a covering letter from parent(who pays for mortgage, other bills be a plus)

On what basis did your spouse get ILR (10 years long residence or 5 years Tier 2)?

On what date did you enter the UK?

You can apply now and submit the documents you have. Are you aware that it will reset your ILR clock and the time spent on PBS dependent won't count towards the 5 year residence requirement? Although you would qualify for ILR in 2017 based on 10 years residence as the rules stand now.

dear CR001, thank you for your prompt answer.
:D
I thought that i would have to wait until 2020 to apply for ILR because the clock is reset. I am glad that option its still there, because the Mrs was pleased to know that I am her prisoner for another 5 years lol.

Clock only resents for the 5 years but as you have been in the UK for 8 years, any valid visa/leave is counted towards 10 years ILR :D

Hello I got the exact same position as zgokool. However my visa will expire in October 2015 and now is only May 2015, is it too early for apply for the Spouse visa as I got 4 months before the current one expires? My partner got the ILR last year though.

Thank you so much in advance

Unless you qualify for SET(LR) faster, then you should switch to FLR(M) as soon as possible, since the 5 years qualifying period for SET(M) starts when you are initially granted FLR(M).

Thank you so much for your help. Can I ask if I need to register as married with him in the UK as we have already done so in our home country? Is it sufficient enough or we still have to register here for the Spouse Visa application? Many thanks

No, not necessary if you have a valid marriage certificate from your home country.
