Help My Situation Please

Hi all,

I will like your advice and guidance on my situation, I came to the UK in 2005 illegally, however I have tried numerous

time to regulate my status, so far it's has been unsuccessful.

My progress below of trying to change my status.

In 2009 i applied as a dependant on my uncle who is an EEA member, but later lost his job and went on claiming benefit so

the application was thrown out.

In 2011, I married an european lady, sent in my application for a spousal visa under the EEA. I was refused and refer to

appeal my case, however the appeal was thrown out as well. The Home Office insist the marriage was a proxy one and it's no

longer acceptable.

There was difficulty in our marriage and subsequently me and my wife divorced.

Now i have a partner who i have been with since 2011 and and she's on ILR and we have got a son, I will like to apply for

a limited residency based on my son being born here and my partner being on ILR.

Please i need your help on how to apply
What documents needed
What form and if possible any other things that can be useful to support my application

option 1 -- what the govt would want you to do -- you can apply for a spouse/partner visa under appendix FM - your settled partner can sponsor you just as a citizen would -- provided you have proof of cohabitation for 2 years. In cases when couple have children together it should be doable but prepare for a fight because of your history.

However -general grounds for refusal are not really applicable in Appendix FM cases, so your previous immigration history will not count.

be careful stating that your relationship with your partner staretd during the same time you were defending application for EEA documentation based on your other marriage, as they may attach a fresh deception claim

was there ever a deception claim against you in the past?

what's the child's date of birth?

will your partner qualify to sponsor you financially under appendix FM?

You will need to leave the country to make the application so this has to be 100% solid and may take time. Do you have a passport?

option 2 - you can apply on access to child or private life grounds. a lot of considerations here, including you and your partner's nationality, how long have THEY lived in the UK, etc etc. a whole new consideration
