Proof of Tax Paid and CGT

Post by lozmichelle » Wed Jun 10, 2015 2:35 pm

I am hoping someone may be able to enlighten me....

I am confused about the requirements for TAX under 'Details of your employment' section 1.48 onwards.

I have always been employed and paid tax and NI through PAYE (other employed by agencies or directly by employers.)

Do I simply put in the timeline in pt 1.53 the from and to dates, occupation and employer info- DO I NEED TO PROVE TAX PAID? I cannot tell if I am meant to include P60's or payslips or other documents for this 10 year period. Please advise.

Also, I sold my property in December and am living off the proceeds, but am yet to sort out the payable Capital Gains Tax, as I have until next year to do it, and it will be a time consuming process. Is this an issue? Will I need to show this tax has been paid or can I put in my Naturalisation application without it? And do I need to notify the Home Office in some way on this form that I am living off this money i.e. not currently fully employed, and have tax that will be owing?

I need to put my application in ASAP as I need to travel in August, hence my need to get this in prior to paying my capital gains. Will this be a problem?

You don't need to show anything to prove that you have paid your tax. Home office will check your tax records when you give them your tax reference number in section 1.52

Was the property you sold your only property ? I mean where you living in it at the time of the sale ? If that's the case there is no CGT due or payable. If not then you need to declare it in your personal tax return and submit it to HMRC. You don't need to tell the Homeoffice that you are living off the proceeds

Thank you so much for you answer!

I mention the Capital Gains tax as it was an investment property I was not living in, and I cannot claim it as a lived in property, so have to pay the tax (I have checked this with an accountant). Are you saying that I should submit this tax return for this CGT BEFORE I put in my citizenship application? Or can I do it later in this tax year (as it's not over yet.)

Will the Home Office be able to check that I have sold a property or have unpaid tax due on it? (during my application period I mean.)

In regards to my employment- thats a relief that I don't need to provide documents.

However, how do I know what my TAX REFERENCE NUMBER is? I am sent a number every time I join a new agency and they keep changing, sometimes I have 3 or 4 at once, as I may work for 3 or 4 temp agencies. If I've understood correctly- the 'tax code', yes?

You can submit your tax return after you apply for naturalisation as the deadline is not until January 2016. Home office can't check unless it is in your tax return

It should be on your P60. Your employer PAYE reference number.

Thank you!

Apologies for the further queries....

In regards to my investment property, I mistakenly never paid tax on the rent earned and was planning to coordinate this with my accountant and declare it in my tax return, which as you say isn't due until Jan 2016. If I don't submit the tax return until after my Naturalisation application (and its great if I can do this)...will this lack of tax paid on rent show up in any way?

I just don't want to do anything that would jeopardise the 'good character' requirement.

And the Employer PAYE reference, I have found that now on my last P60 for 2014, thank you. However, does each different employer have a different number (as I am signed up to a number of agencies.) Or is it always the same number, no matter who you are employed by?

Strictly speaking you should have declared your investment property to HMRC and pay tax accordingly. However Home office cant check lack of tax paid on rent as the investment property wont show up in HMRC records as its not yet declared to them. So it wont effect your naturlisation application. However i would recommend that you make sure you submit your tax return and declare your rentals after your application and pay the due tax accordingly.

You should give reference as per your latest P60
