Dear Experts

I would need your suggestion and advice to apply for FLR (M) for my wife, please find below my details

I got my ILR in December 2014 and i quit my job and became self employed from march 2015. My wife was in india when i applied for ILR and she was still on my previous Tier 2 ICTdependant visa at that time

She travelled to UK in FEB 2015 and i want to apply for her FLR (M), when i contacted a visa solicitor he charged me 50 pounds for consultation and he didnt answer any of my questions and was checking the internet to find the reply, to be surprise he checked immigrationboard forum. Since he was wearing glasses i could see from the reflection and i knew it was this site he was checking from the header design of the website. Hence i decided to post my query in this forum, rather than spending money on the solicitor

1. I started my new contract in March and the first pay was given in May end, so my bank account doesnt reflect more money between March and May
the solicitor told me that i dont have enough money to prove that i can apply for FLR (M), he said i need 25K minimum as my salary, I spoke to my accountant and he told me we could apply for PAYE after getting the proper figure from the solicitor
The solicitor told me that a minimum of atleast 700 should be in my bank account from last 90 days. I dont have minimum balance everyday. There have been money inflows and outflows.

I am really worried now and would need your expert advice or any suggestions which you can give me in this regard

P.S: my dependant ( wife ) is not working and is a house wife

All nonsense advise.

1. If there are no children, the financial requirement you have to meet is £18,600 per annum and as self employed, you will need to provide income and proof of self assessment tax etc.

2. You do not have to maintain a minimum balance for 90 days for FLR(M).

3. Switching to FLR(M) will reset her ILR clock to zero and she will have to wait another 5 years before applying for ILR. She will also have to pay the IHS surcharge.

4. Your wife can continue to extend her Tier 2 ICT dependent visa but only if you got ILR based on Tier 2 with 5 years residence. She will have to switch to FLR(M) if you got ILR based on 10 years long residence. Tier 2 ICT dependents are exempt from paying the new IHS Surcharge of £200 per year upfront for duration of visa (FLR-M is 2.5 year visa so it is £500).

Thanks a lot for your reply. I have a child and she was born here in the UK and hence we have applied for birth registration using form MN1.

1. I have P45 from my previous employment which was on feb.
2. The inflow of money into my personal account is not constant, there have been times where i have withdrawn more from the business account.

Can you please provide me some more details

When did your wife initially apply for leave as your dependant?

she travelled to UK first on Tier 2 - ICT dependant on AUg 2013 and Left to india on May 2014
She came back to UK again on Feb 2015 and her visa expires on August

Can i apply for ICT tier 2 dependant extension now for my wife? if so as per my understanding the last 90 days balance should be more than 630 GBP. please advice and suggest

As the child was born in the UK and you are now on ILR, the child has an entitlement to be registered as a British citizen. Once the child is registered British, s/he will not count in the minimum salary requirements. So, you need only show £18,600 per annum.
