The good character requirement changes were introduced in December 2014, however they will apply to any pending applications that hadn't been decided, irrespective of when the application was initially made. If your breach in immigration was within the last 10 years, then it is likely that the changes may effect the outcome of your application. It may help if you can quote the exact refusal reason text, removing any personal details. At a glance the 10 year ban you refer to appears to indicate that you failed to meet the Good character requirement.barzi wrote: i received a refused Naturalization letter and a banned for 10 years.

When did your visit visa expire? If you did not attend the asylum interview, how long have you now overstayed? And how were you granted ILR? At a glance it's difficult to understand your immigration history. I came on visitors visa and sought asylum through lawyers but when I was called for interview at the home office but I didn't go and therefore I overstayed? I tried again to seek asylum after some years and I didn't hear from my lawyers.
When (date) was it that you were granted leave as a dependent (I.e. the date your stay in the UK was regularised)? Based on my understanding of your circumstances, from what I can see, the outcome of your naturalisation application would most probably depend on whether this date was 10 or more years in the past from when the HO consider your naturalisation application.Kiki30 wrote:I got papers as a dependent we had a child together and got married in 2010 we got the ILR in 2010.

Applied asylum in 2001 while was on visit visa
Appeals exuasted
In 2004 further application sent under human rights
Left the UK volunteraliy in 2007 whithdrew pending application
Married in 2007 in abroad but came to UK in 2009 on family permit
Got RC in 2010 and got PR last month.
Do I come under 10 years ban or not
Because my application was pending when I left and than came again legally after got FP.

Mate it doesn't matter!! You were tried in court and convicted, despite you got a community work sentence, it's still a conviction. You shouldn't have been selling illegal cigarette in the first place. Now you fail the good character requirement and have to wait 10yrs. Sorry to sound harshbarzi wrote:Hi Amber i need you're help.

You have to wait three years after you receive a caution before you can apply for naturalisation. In your case, I believe you meet all the requirements . It's been over 10years, you shouldn't face any problem.Sibusiso wrote:Hi,

Could you shade some light on when you were arrested? Unfortunately even a day of prison is classed as custodial sentence which rules you out of good character requirement. So you have to wait after 10 years from when you was sentenced
I *think* (and I'll just say I may well be wrong) it's 3 years because it's based on the court sentence. It's entirely possible to spend a couple of nights in prison and be released without charge, or be found not guilty etc and that'd wouldn't affect your application. You see I did not spent even a day in prison and wasn't sentenced to prison time. I was sentenced to pay fine but as I wrote the 1 day in arrest counted towards the fine and lowered it by 50 pounds.
As far as I know you can be arrested for anything up to 48 hours but you can only be imprisoned by court. Prison and arrest are two different things.
So in my case would you say 3 or 10 years?
What was the exact reason for your refusal? A 10 year ban is usually if you have a conviction and you don't declare it because they consider it deception.barzi wrote:Hi Amber i need you're help.
