Wasting HSMP application

Due to the uncertainty with the immgration law one of my friend after getting HSMP approval in UK decided not to switch from WP. Is is unlawful in any ways?

I believe it is still legal as long as U have not got FLR on your passport.
However I am not 100% we still need the real case example from pople who are in the same situation.
