Work pending spouse visa

My wife came to the UK on a fiancee/engagement visa. We have now got married on the 9th May 2015, and have now just submitted out FLR (M) for spouse visa

We have been advised that my wife can actually work now that we are married, and that we don't actually have to wait until we get the spouse visa before she can work - an immigration advisor advised us of this, but it was news to me and I can't see it writen anyway (indeed to the contary)

Therefore I was hoping that maybe some one on this forum can clarify - can my wife work now married but pending spouse visa which we have applied for?

As you suspected, you've been given bad advice. It would be illegal for your wife to work in the UK until her FLR(M) visa has been granted. Any period of illegal employment could have a serious affect on any future visa applications and her employer would face a £10,000 fine.

Regarding our application I sent it last Friday (the 12th) by recorded/special delivery. I can see it was signed for last Monday, but do we get any official notification from UKVI that they have received and are processing?

Yes I believe should do and also a Biometrics letter.

The confirmation letter and the biometric letter arrived on Saturday

We went to Manchester Post Office to register her biometric information. However my wife made a mistake signing her name, and the Post Office clerk submitted it before we were happy with it (the booth was dark she couldn't see what she was doing, and the clerk was clearly in a rush to go home as they were about to close)

Could this (or is it likely) to create problems further down the line? Should I call UKVI to say what happened? More poor wife is worried sick she could be denied her visa for such a small mistake and one of which was not her fault

She mis-spelt her surname, also she only signed it in English

On the application she signed in English (which is basically just a print) and Thai. You see she doesnt really have an English signature

In my honest opinion, I believe it would be wise to contact the UKVI and request that she does the biometrics again. The BRP is going to be the major form of identification for immigration purposes. Better to get it sorted now than to worry about problems later on.

Is there any chance that as the staff member who took the biometrics was in a hurry to finish they may not have sent them off yet?

That was my thinking, will call them tomorrow - was just worried that this would create problem, they would have contacted us though wouldnt they if it was going to be a problem, they wouldnt just reject the application out of hand because of this?

Yes he sent them, it is all done electronically, it was an e-signature and he sent them off electronically there and then. Indeed we said we wanted to do another signature, but he said sorry to late that he had already sent them. I was not happy as you can imagine, as we had already complained it was to dark to see what we were doing

They wouldn't reject the application. If they spot the mistake in the surname they would ask for the biometrics to be retaken but it's better to notify them first. Your wife can choose just to sign in Thai. My husband (who has BC now) has always continued to sign for everything in his Arabic signature.

I will request they are done again (which I guess is pretty straight forward?), and this time we will just sign in Thai. My wife will be happy with that.

Just hope it doesnt delay her application, just by the length of time it will take them to send us another letter?

It shouldn't delay it. They won't have started to process the application yet.

Hello Casa

Well I requested a new biometrics letter on the 23rd June, they said it would take 15 days to issue

Today chased up the letter but UKVI said that Biometrics wouldn't be sending a new letter, that they were satisfied with what we had submitted. That they had no need to send us a new biometrics letter

Does that sound right? The error has been flagged to them - but they saying no need to do biometrics again?

They're obviously happy with it, which means it won't affect the visa application.

Just wanted to let you all know that we got the visa/residence permit this morning - as you can imagine we are very happy - and it only took 4 weeks!
