Please help! Previously overstayed and want fresh start

Post by Alberty » Sat Jul 18, 2015 9:53 am

Hi guys, i hope this is the right place for my question.

I have found you on internet searching for a solution. I have a question about my special problem and maybe you can help me. I am from a non EEA country. I have been to Ireland on a visit visa for 3 months in 2007. During my visit i have found a job at a restaurant without a work permit and I didn't want to go back to my country. So i have overstayed about 7 years. I have applied and received a pps number on my own name and real information and i have used my pps number for different jobs to work. I have paid all my taxes during this 7 years legally. Then i have decided to go back to my home country. After 2 years of my return home, i have applied for a job on a jobseeker website and i had an interview. The interview was successful and i was offered a job in Ireland and now i can work legally with a work permit.
My question is does my previous illegal situation in Ireland effects negatively my new general work permit application? Can i make a fresh and legal start with my new job? Do i have the right to work legally in Ireland now? Do i have to pay fine or something? I would appreciate if you answer my questions.

Thanks in advance

" I have paid all my taxes during this 7 years legally", like you had any choice in the matter. Everyone Irish and residents pay taxes difference is they legally here and you deliberately overstayed which is a breach of your visa conditions to which you agreed to abide by and then ignored. The PPS number will provide a record of your stay in Ireland via dept of revenue and show if given a visa you are unwilling to abide by the conditions. Sorry but you have painted yourself into a corner should have applied eight years ago.

Thanks for your answer joker. You are absolutely right about that. I deliberately breached my visa conditions because that time i had to do it even i was regret about that. Now i want to fix my situation and do everything legally. If there is a solution or fix, I desperately need it. Thanks for your answers.

The INIS does not take lightly any breach of normal immigration controls. Obviously you deliberately circumvented normal immigration controls by applying for and entering Ireland for a 90 day visit visa and overstaying and working illegally for good long 7 years. I'm afraid to tell you that you're in a precarious situation and doesn't look good for you getting successful with your latest application for a working visa. However, you may try to seek a second opinion from a good immigration solicitor who'd be in a better and technical position to advise you on this matter. Good luck to you!
