non-EU citizen partner visa

Post by bobbier » Wed Jun 17, 2015 3:06 pm

I'm non-EU who wants to apply for partner visa with my boyfriend (EU) in the Netherlands.
I have checked but I got some questions so if anyone who already through this or knows about,
please kindly let me know.

1. We met here and dated almost a year but we haven't lived together since we have our own apartment.
Then we are not qualified to apply for partner visa? Or is there anyway to apply even if we haven't lived together? We haven't lived together and we do not have both named account as well.
(However, we can prove that we've been together with letters, photos, travelling tickets.)

2. Should we prove that we both are single with apostilled documents?
Is it possible to show them with certificate of family relationship?

3. Should he register me and himself at his home-country immigration and apply here again or can we just apply for partner visa and process everything here?

I read many articles, information but it was a bit confusing so I hope someone can help me with above issues.

Have a wonderful day.

Sincerely,

There is no 'boyfriend/girlfriend' (or same gender friend) EU permit. To prove a durable relationship 'akin to marriage' you would need to show that you have been living together, preferably for two years.

Thanks Casa,

I mean we're trying to apply for the partner visa in Holland.
But like I said, we both have own houses so we didn't live together. Then we cannot apply for partner visa?

Thanks in advance.

No, because you don't live together in a relationship 'akin to marriage'. At the moment you would be considered as boyfriend/girlfriend and there isn't a visa/permit category that is available for that form of relationship.

hi casa, following your response with the other post. just want to know if there is a young child in the relationship were both parents live together but are not married, do they still have to prove 2 years of being together regardless of the child? i'm just posting in a case where they both live in the eu state and eu citizen exercising treaty right.

Co-habitation in a durable relationship would still need to be proved, regardless of whether they have a child together. They may be successful without the full 2 years under EEA Regulations.
