Parent of a British Child Visa

Post by Megarjonny » Sun Jul 19, 2015 9:57 pm

Hello folks, I'm in a bit of a dilemma, well...
My mother is Brazilian, is married to my father, who is British, but they're no longer together, they had two children (My brother and I). 15 Years ago, she had some issues with my father, so she decided to come to Brazil, and she brought us along.
Now I'm almost 18 years old, and my brother is almost 17 years old, we are planning on going back to London, since we have british passports, to continue our lives (And meet our father, who is very sick now). She tried to renew her ILR(Indefinite Leave to Remain) Visa, and was unsuccessful, because the immigration officer alleged that she had no strong family ties with England. Then, she applied for a family visitors visa in other to take us to England, which was again refused, because the immigration officer, this time, was not convinced that she wouldn't stay in England, since she had applied for a settlement visa before.

The point is: She has a Brazilian daughter, and she's a lawyer here, and is a partner in a legal firm. But still they were not satisfied. She didn't apply for a "Parent of a British Child Visa" because, from brazil, the visa applications must be made online and, on the website, there isn't that option (https://www.visa4uk.fco.gov.uk/home/welcome)

My questions are:
  • 1.Do you know, what kind of visa could she apply for online here (https://www.visa4uk.fco.gov.uk/home/welcome) ?
2.If she travels with us to England without any visa, would she get deported? Would all of us be sent back, even with our British passports?
3.Can she send us with another responsible adult, and then try to go later? How should she do that?
We would appreciate it if you could help us.
Thank you in advance, we look foward to hearing from you
Best regards :)

You mum might be able to apply on the basis of your brother who is under the age of 18, but your brother will first need to enter the United Kingdom. Immediately after his entry, your mum can apply.
