Expiration of Tier 5 (YMS) - still be a Ltd Coy director?

Post by ashreynolds » Mon Jul 27, 2015 1:20 pm

Hi all,

I haven't had any luck finding specific guidance on this issue and was hoping for your help, apologies if this has been answered previously.

My Tier 5 YMS is due to end 15/12/15.
I'm the sole director of my Ltd company.
I'll be leaving the UK in early December, returning to Australia.

Whilst I believe I am unable to pay myself a PAYE salary through my company post 15/12/15 (i.e. breaching my visa), am I still able to:
1. Hold a directorship in my company;
2. Pay myself dividends as sole director?
3. Receive payment for outstanding invoices from suppliers (i.e. if i'm issuing invoices on 30 day terms, payment of the last few invoices i've issued may not be due for payment until after 15/12/15).

This may be more of an accounting/tax question, but keen on any advice as to whether I must liquidate my company on or around the expiration of my visa, or if my company can remain current, as long as I don't pay myself a PAYE salary.

Appreciate any and all assistance.

Cheers

Ashley
