IRL - Dependent Visa - Help

Hi All,

I am in a very delicate situation. Appreciate if you provide a solution.

I will be applying for ILR in 17/05/2016.

My wife's PBS dependen visa was issued on 10/07/2014. If she apply for the PBS dependent extension for 3 years when I apply for my ILR she will be 2 months short of 5 years in 2019 and wont be elligible for ILR.

Do you know any way to get around this?

She will need to apply for an extension to cover the shortfall. If you apply by post for her extension, she might just get the visa which will get her to the 5 years.

Someone told me that if I go for a same day appointment for my ILR I could post my wife's application up to 28 days late from the day her visa expires and this won't be considered as overstay due to some immigration law. I can find about this anywhere in the UKBA website. Can anyone help if u know about this more.

Date of entry of your wife in to UK?
Date of expiry of her current leave?

Apply for extension as PBS dependant only a couple of days before 17-05-16 by post.
If I were you I would apply on 16-05 or 17-05 by special delivery / courier and keep the proof of posting safe.

Like CR001 has hinted, by the time her application is processed by a caseworker and a decision made on it, she will hopefully be within range to be able to apply for settlement without needing another extension in 2019.

Applications made after expiry of last period of leave
37. Applications for leave to remain under the Points Based System will fall for refusal if you have overstayed for more than 28 days on the date of application, unless there were exceptional circumstances which prevented you from applying within the 28 day period. The 28 day period of overstaying is calculated from the latest of:
• the end of the last period of leave to enter or remain granted,
• the end of any extension of leave under sections 3C or 3D of the Immigration Act 1971, or
• the point a written notice of invalidity is deemed to have been received, in accordance with paragraph 34C or 34CA of the Immigration Rules, in relation to an in-time application for further leave to remain.
If there are exceptional circumstances which prevented you from applying in time you must submit evidence of the exceptional circumstances with your application. The threshold for what constitutes ‘exceptional circumstances’ is high and will depend on the individual circumstances of the case, but for example may include delays resulting from unexpected or unforeseeable circumstances such as the following:
• serious illness which meant that you or your representative were unable to submit the application in time (where supported by appropriate medical documentation).
• travel or postal delays which meant that you or your representative were unable to submit the application in time.
