You and I are only a week apart. My docs reached BHC on the 27th May. I will follow up on my application probably when my 11 weeks are up by which time you may have had your reply from them inshallah. You might even hear from them this week. And as far as your case is going positive or negative, one never knows until you open the envelope. Best of luck

If your application gets declined because your wage slip anount don't match the amount on bank statment.

What is the best next step to take, appeal or just do a fresh application?

Some say appeal, others will say to reapply.

Appeal cost = £80-£140 - outcome can take from a couple of months IF you're very lucky, to a year or so.

Fresh application = £1556 - outcome usually within 2-3 months. Cost isn't including redoing TB test or any other fees.
TIMELINE

Spouse Visa (Entry Clearance) granted on 20-02-15
FLR-M (Extension) granted on 24-08-17
ILR (SET-M) not due until 2020

To do fresh application will you have to gather 6 month wage slips etc all over again. Or can u use some of the previous months wage slips.

For example my first application is submitted in for example July and declined October. Could I use wage slips from before July or will it have to be after wages after October so month 1 would be November.

Well if one of your payslips doesn't match the bank statement, then you have to start counting from the next payslip onwards.

I don't see why not.

What is the best next step to take, appeal or just do a fresh application?

Firstly why were the payments wrong? did you yourself put less in or was u payed less by the employer??...

FOLLOWING IS MY OPINION ONLY

If it was due to your employer i would appeal as your employer can write a letter to verify this and he/she can also confirm what your regular pay is and this can also be verified by checking with hmrc if it was a one off mistake, after you appeal it would take up to a week or more for the fee to be taken (£80 for paper hearing, £140 for oral, oral is best as u can speak directly to the judge on paper its just whats there to look at i.e supporting documents) and then 4/6 weeks after that u receive appeal notice with your deadline (15 weeks they have) and then normally 28 working days (6 weeks) u get a decision if review is successful, if not then it is refused and taken to court and it can take a further 4/6 months for a hearing date and if u need a lawyer to represent u (which would be wise) they would charge £800+ maybe more (and if u hire a lawyer to lodge your appeal its a further £800=)

however if u go for a fresh application its £996 and £600 nhs fee, u would also need to re do paper work, including
-employer letter
-accommodation
-declaration
-6 slips and corresponding bank statements
- TB test
- and possibly English test to as a few expire November 2015

so that would all cost maybe a couple of hundred, but waiting time may be less depending on how quick they are issuing visas at the time. and even then u never know they could take out another mistake (what they didn't point out in first)

but best option is to think about it and weigh out the pros and cons personally.

p.s also have a look at my timeline for rough processing times.

Unfortunately it is not one of mistake, I have noticed that:
April: I have been paid less by £22.80
May: Over paid 20p
June: Over paid 20p

I have 2 jobs mistake is from my second job. I am thinking of applying but leaving out my second job, instead I will put wage from 1st job & then I will put my family has gifted the rest of amount to me so I can meet the financial requirement. Will this be ok it will it go against me?

Thank u for ur advice.

What if I get a letter from the employer saying he has paid me the wage that was under in April & that I have paid back the over payment of total 40p back to the employer?

Will this be ok?

Also why would the savings have to be so much? I thought the savings would have to make up for the remainder of the wage i.e i earn £13,500 so I am under by £5,100. Why can't savings be of £5,100?

I'm not too sure but I think it would be okay as long as your employer verified it but then again they may want proof

And regards to your 2nd question

The first £16,000 of savings are not considered and the spouse visa is for 2.5 years

So your shortfall is £5,100 x 2.5 = £12,750 + £16,000= £28,750 so u need that in savings

Will this be ok?
I'm not too sure but I think it would be okay as long as your employer verified it but then again they may want proof

And regards to your 2nd question

The first £16,000 of savings are not considered and the spouse visa is for 2.5 years

So your shortfall is £5,100 x 2.5 = £12,750 + £16,000= £28,750 so u need that in savings
Thank you for ur help.
