FLR (FP) For Overstayer - Help!

Post by nihlsa » Fri Aug 07, 2015 1:00 pm

Hi there everyone

I have someone who has a British wife and they have three children together - 8, 5 and 3.

The children have British passports but the marriage has broken down. The parents are still married but not in a married relationship.

The father came to the UK in 2012 as a family visitor and has overstayed since. He did apply for a derivative residence card but this was rejected due to poor evidence.

I was wondering if it's possible for him to apply under FLR (FP) 10 year route? But he is an overstayer and so not sure what he is able to apply for. Both parents are on good terms and they have arranged contact between them for the kids.

Any help will be much appreciated. Thanks!
