Well, that's where the BRP will help I think:) What do they have to report if the passenger shows a visa with the expiry date of 2016? We also think the HO wouldn't just send it back to us if it was cancelled. Anyway, we'll see soon if it's valid or not (hopefully not the hard way!)

Applied ourselves, I am Australian and my wife is Hungarian, our timelines are:-
EEA (FM) Submitted: 29/06/2015
Royal Mail Acknowledgement of delivery: 30/06/2015
Money taken out of account on: 02/07/2015
Biometrics letter dated 02/07/2015: (Received 06/07/2015)
Biometrics submitted at post office: 08/07/2015
Request for Passport Return: 13/07/2015 (Note, well and truly over the 10 working days!)

I have called them almost everyday now and I get the same dumb message 'It should have been issued within 15 working days' so angry and frustrated with the system at the moment!

well personally i dont think asking your passport back is bad nothing wrong it! as many people n here did it before you and got it! prime example is raume from july applicants! but i personally think you should have waited for COA and the you could have asked for your passport! but now you have spilt the beans again i am assuring you nothing wrong in asking for your or you partner passport back but you know how things are these days so its better to be careful! but according to opinion i would suggest dont give up and keep calling then again and again! and lets see its now other july applicants responsibility to reply as well as we all have to watch out for each other! but how did u applied? through a solicitor or urself?

Thanks, we applied ourselves, we lived in the UK previously (I was transferred with work) and we have a history here already.

We even sent the paper work to show we had a history of living here!

I asked for my passport back, because frankly, the department does not fill me with confidence.

As a Australian Citizen, I can enter the UK without a visa and I can stay for up to 6 months (without the right to work) as this is a reciprocal agreement between Australia and the UK. So I do not see how requesting my passport back is an issue!

I'm worried they might have sent it to my old address as we have recently moved but I updated my current address at change of circumstance online.. I'm just tired of calling them all the time as it's draining most of my optimism.

It true that I also lack trust in those people after they mishandled my first application.. I know what you mean UKBA...Arrg.

Sorry what do you mean you requested your partners brp back ? Our lawyers told us that the old visa is automatically cancelled when you apply for eea2

Hi Alex,

We did not use a solicitor, made the application ourselves, but I haven't seen that piece of info anywhere...

However we have had 1 meeting with a solicitor, and when we asked about travelling during the 6 months period, I remember him clearly stating that if my partner had a valid visa, he could travel anywhere as he wishes. Which made sense to me but apparently solicitors have different opinions on this?

Maybe someone who has applied while in possession of a valid BRP/visa can enlighten us on this?

I also wanted to update my timeline here, as we just received the COA today, WITH right to work, which is amazing! We haven't been expecting this as we applied as unmarried partners, but I believe that must also be due to him having a valid BRP until mid 2016 which gives him the right to work...

Hi Alex, thanks for the good wishes. He'll be back early September, I'll let you know how it went. He's from Turkey and that's where he's going.

And yes it's possible to request it online. As far as I can remember, the form gives you a small list of documents to chose from, and for anything else that is not on the list such as the BRP, there's an 'other documents' option, or something similar. You can type in any doc you want under that option. Just have a look at the form and you'll figure it out straight away, it's pretty easy.
