hi,
my wife applied on 5/5/2015 from pakistan, and the reason of refusal is financial requremnt
i claimed income as a permanent job and as director of limited company
i provided salary slips from 1/11/2014 till 30/4/2105 will total about £16000
than i provided dividnd voucher of about £7000 covering period of 1/05/2014 till 30/4/2015
i also provided last 3 year tax return CT600 2011-2012 2012-2013 2013-2014
Decision says, ur salary slips and ur last tax return of 1/2/2013 to 31/1/2014

as stated in FM-SE 13(e) income from salaried employment needs to b evidenced covering the last 6 months of that same financila year as the CT600, so ur application is refused


my company financila year runs from feb to january every year
my questions are

1)why ECO didnt consider my dividend voucher from 1/5/2014 till 30/4/2015 ?

2)what you think they calculated my income in a right way?

3) should i go for appeal or review?

plz advice me urgently thanxx

Sorry to hear this

I can't advice u as this is not my field but what I can say for spouse visa there is only appeal or re apply no review, review is part of the appeal process it goes through review and if not successful then to court

I'd say if it is something that can be corrected easily then go for appeal

I'd say if it is something that can be corrected easily then go for appeal

I think it's because ur last 6month wage slips are over this year and last full financial year... But I'm not sure

Firstly, sorry to hear of your refusal.

I applied using the same route as yourself, so might be able to help.

I'm a little confused from the information you have provided, but my feeling is that your dividend voucher must fall into the same financial year as your CT600 and be shown in your accounts. Your company's financial year runs from February to January. The last period would therefore be Feb 2014 to Jan 2015. Your dividend certificate and your payslips (12 months) should also have been from this period.

You didn't say you included the CT600 from Feb 2014 to Jan 2015. Was this sent?

Unless I am mistaken, you come into the 'director of a specified limited company' category. If so, did you supply all the information this section specifies? I.e. personal and company bank statements for the 12 months covering your CT600.

I'll wait until you come back with further details. I would suggest holding off the appeal or review for now.

Can someone CONFIRM exactly & define from which date does the 12 weeks period begin from for a settlement visa application to be processed Is it from the online submission of application & fees paid Is it from the biometric & documents hand over at VAC Is it from the date that BRITISH HIGH COMMISSION or Sheffield UK receive our documents So which date does it go from. 12 weeks or 84 days could you tell me if it includes weekends or is it just working days

thanxx for ur reply, i provided 6month salary slips from nov2014-april2015 as they want most recent salary slips

last tax return i files was feb2013-jan2014 and 2014-2015 i will file in jan 2016 plz correct me if i am doing any thing wrong
dividend voucher was covering from may2014 to april 2015 as they need whole year detail for self-employes..so it will cover salary slips time as well nov2014 to april 2015....i also provided business bank statment same as dividend voucher frommay2014 to april 2015 but personal statement of last 6month covering salary slips....all didvidnd voucher earing /transection was in the month of march 2015 so also covered in pesonal bank staement.
plz guide me as i m thinking to reapply....or if need we can talk on phone...i will be thankful to u..as i m really confused about this

If the answer is yes then why didn't you submit your application with Feb 2014 - Jan 2015 accounts?

If you are applying through the "Director of a specified limited company" route, they want to know that your company is making enough money to pay your salary and has enough left over so that a dividend payment can be made out of the profits. The dividend received is not in line with the submitted accounts, so they have no way of establishing whether one is permitted or not.

I am now giving up trying to understand what your message says as it is so hard to read.

Here is what applies in the case of a “Director of a specified limited company” and the financial year you are applying for is Feb 2014 - Jan 2015:

Get your accountant to prepare accounts for the last full financial year, assuming this is Feb 2014 - Jan 2015.

Was a combination of your salary and dividends higher than £18,600 during this period? If not then there is no point in you applying until the end of the next financial year, on the basis that the combined figure of salary and dividends exceeds the 18,600 requirement.

If it is higher than 18,600 then get the accounts submitted, get the dividend vouchers, pay the corp tax, get the ct600 and ct620. Note: your dividend payment should then have been made within this period.

Get a hold of: Immigration Rules - Appendix FM-SE (Updated 3rd August 2015) and go to the section that starts:
9. In respect of income from employment and/or shares in a limited company based in the UK of a type specified in paragraph 9(a), the requirements of paragraph 9(b)-(e) shall apply in place of the requirements of paragraphs 2 and 10(b).
and read all of this.

If you just found out the decision then take some time to reflect and come back to this process in a few days.

I really appreciate ur guidence , yes I made mistake due to lack of knowledge , I should have filed CT600 of 2014-2015 first and then apply, let me plan my next application I will check if my income exceed £18600 in financial year 2014-2015 , than I will reapply .
..suppose if I apply in sep2015 it means I have to provide my employment salary slips of last 6month from March 2015 to August 2015 which would b about £16000 and remaining £2600 I have to cover through as director of a limited company with financial year feb2014 to jan 2015 and have to show dividend of same time period . If you apply again in Sept using Feb 2014 - Jan 2015 financial year then you will need:
Payslips for each month, starting from Feb 2014 and ending in Jan 2015. Recent ones are of no value in this case.

Let's say that your gross salary (before tax) was £14,000 within this period. That means you need to make up a shortfall of £4,600 through dividends. The dividends must have been paid within this period too. If a dividend was not paid in the same period to cover the 4,600 shortfall, your application will be rejected. As with your salary, the dividend payment must be seen leaving your company's bank account and entering your personal account.

Applying through the limited company route means that you cannot makeup a shortfall through savings or other routes.

The ECO wants to see that your limited company has the resources to pay you a salary and dividend.

I have read earlier posts saying that if you only receive one email then visa has been REJECTED!!!! unless you receive two emails second one with REFERENCE number ......only then your visa is accepted.
is that true????

this is the form i filled in. My wife submitted forms on 27/07/2015, only been two weeks so i doubt there will be another form. The appendix 2 form is not on the visa4uk website. Below is a link to the form. Hope that helps brother

If you apply again in Sept using Feb 2014 - Jan 2015 financial year then you will need:
Payslips for each month, starting from Feb 2014 and ending in Jan 2015. Recent ones are of no value in this case.

Let's say that your gross salary (before tax) was £14,000 within this period. That means you need to make up a shortfall of £4,600 through dividends. The dividends must have been paid within this period too. If a dividend was not paid in the same period to cover the 4,600 shortfall, your application will be rejected. As with your salary, the dividend payment must be seen leaving your company's bank account and entering your personal account.

Applying through the limited company route means that you cannot makeup a shortfall through savings or other routes.

The ECO wants to see that your limited company has the resources to pay you a salary and dividend.

i want to reapply as soon as possible, i have following situations at the moment

1) using financial year feb2014 to jan2015 i don draw salary as a director so i calculated dividend during this period is £2900
and my payslips during this period from my security job is 15800 so total is £ 18700 can i reapply with this situation in sept2015??

2) With situation 1) above i worked domino from setp2013 till august 2014 can i use domino salary slips toward my earning? from feb 2014 till august 2015

3) my next financial year will be ended jan 2016 can i file early tax return in august 2015? i have enough dividend plus security wage slips to exceed £18600

sorry to bother you again and gain but will be thankful to u

Your questions are not bothering me. I’m glad to be able to provide my opinion. I wouldn’t however say it is guidance, as I am in no way an expert.

I’m sad to say that your situation is causing me concern. You are also not supplying sufficient detail to enable me to help you effectively. I cannot ascertain where you were employed through your company and when you were employed directly.

Firstly, you have to be very clear with regards to how you were employed. You mention two jobs: one with Dominos and the other doing some form of security. Did they pay you or did you invoice them through your limited company? If your limited company did the invoicing, which then deducted the tax and NI before paying you a monthly wage then you can use this in your Feb 2014 to Jan 2014 financial year. If they paid you as an employee then other rules apply that I am not familiar with.

Making an application using your own a limited company is not easy. It was a nightmare for me to get the necessary documentation together. Have you gone through the appendix I referred to in my previous post to confirm you can provide all the required documentation? Please answer.

I’m guessing that you cannot use your Feb 2014 to Jan 2014 financial year, as you were not paid through your company as a director and the dividend you received does not on its own help you meet the minimum requirement.

Regarding the Feb 2015 to Jan 2016 financial year, I don’t think you can bring this forward to close this off early.

Sticking with the Feb 2015 to Jan 2016, am I right in saying that your company is paid for the security work you are doing? If so then are you extracting a monthly salary? Is your company deducting your NI and PAYE? Can the £7000 dividend you paid be brought exclusively into this financial year?

If the answer to all the questions in the above paragraph are yes then I suggest that you wait until your accounts are ready for the Feb 2015 to Jan 2016 financial year and then apply.

I’m so very sorry if this is not the answer you were looking for. I would therefore suggest you seek another opinion. Maybe I have missed something that could enable you to apply now. Perhaps someone else on this forum could help.

Hi guys

It's currently been 7 weeks since biometrics and I asked for a update today and it said there are no current updates or the information you have provided is incorrect. Should this still be happening on week 7? I thought it would at least be in progress by now.
