ILR dependent visa for wife and kid

Post by KVP » Fri Jul 31, 2015 5:52 pm

Hi there,

I need a help from you please.

I got my ILR last month. I want to apply for ILR-Settlement Visa for my wife and kid. To start with, please guide me to the correct guidelines, forms, required documents, etc,.

My immigration history:
1) ILR holder - ILR through 5 year Tier 2 PBS work route (SET O form)

My family immigration history:
1) Wife: Tier 2 PBS dependent until she left UK on December 2014 (for maternity). She was a Tier 2 dependent under old rules before 9 Jul 2012. But her visa was expired by December 2014, as she did not extend Tier 2 PBS Dependent visa.

2) Kid: was born in India and 3 months old now.

Thank you..

Do you earn £22,400 per annum?

Hi Casa,

Yes, I earn more than £22,400 per annum.
I work as a contractor (self-employed) through my own limited company.

I have a little doubt. I do not have enough cash savings at the moment (I read somewhere that a total of £16000 cash saving can be provided as alternative to employment related evidences). Do I need to show 6 months bank statement having at least £16000 cash savings throughout 6 months at anytime? Also I don't know if £16,000 is sufficient for both wife and kid. I am looking to work out this plan (to save money for 6 months). I ask this question as the contract job carries risk of redundancy at anytime., you know what I mean.

My wife - not working, home-maker.

£16,000 is the lower limit to make up for any shortfall in earnings. (Savings below this level won't be considered). If you were relying on savings alone you would need £72,500 held in an accessible account for at least 6 months.
If you rely on earnings as a company director, you will need to submit the last 12 months of accounts as submitted to HMRC.

Oops, I read it wrongly then. Ok thank you. I will work out to show the "documents submitted to HMRC" as Company director since that is only feasible option for me now. I plan to apply Visa for my family in November.

But.... I recently joined as a Contractor in June, so my tax return would be on next year, I believe. I worked as permanent employee to two companies (where my salary was around £34,000 per annum) until I got my ILR. I have the pay-slips till May 2015 (I have them from Previous_employer_1 for Jan2015 - May2015, and from previous_employer_2 for at least a year before).

Is there a good way now?

Also please guide me to guideliens/forms/required docs,..etc.

Thank you very much for your reply.

You may have to wait until next year, to be able to sponsor them, once your 1st Tax Return returns.

Thank you Obie and Sushdmehta.

I have heard from someone that ,
Instead of waiting till Mar 2016 to get HMRC tax return documents, we can show running documents, like payslips, Bank statement, and letter from Accountant. etc., (combined with my earlier P60/P45, payslips, bank statements ) for last one year to prove the financial requirements. If that can be done, what all documents should I prepare for?

Anyone came across this situation?

Please note that I am the sole director, shareholder and employee myself (only one) for my company.

Hello experts,

Is it possible/advisable?
Have you heard of anyone submitting combined documents (as in my previous post)?

Thanks, KVP.

Read the links provided. It isn't always that simple - some of the categories for the financials cannot be combined.

What we 'hear from someone' is not always the case. Have a read for yourself!
