Sponsorship for non EEA

Post by salao » Sun Aug 09, 2015 8:41 pm

Hi,

I am a Spanish living 8 years ago in Ireland . My girlfriend is from Mauritius , living currently in Canada as a permanent resident. She lived in Ireland for 7 years with a student visa before leaving for Canada and she stayed illegally in Ireland for a few months while her Canadian Permanent Resident visa was processing . We are going to get married in Canada and then we want to live in Ireland.
I would be grateful if someone could give me some info, or refer me somewhere where I can be advised about what to do for her to get the papers. P.s: She still has Mauritian passport which implies that she needs a visa even to go on holidays to Ireland.

Thanks for your help.

once married in canada your partner can apply for accompany EU spouse visa under directive 2004/38/ec to Ireland to travel with you there. if you search this directive on the forum there is a lot of information which will help you

If I understand ok, under this directive, she can come with me to Ireland but for a limited time of 90 days. What can we do after that period?
And another big issue I'd like to know is if it would be a problem that she has been illegal for a few months in Ireland until she got her canadian residency.

Thanks for your help, it is much appreciated :)
