Can a child born in UK apply for ILR after 7th Birthday

Post by anjovu » Wed Oct 31, 2007 7:32 pm

I have been in Uk for the last 14 years and never travelled back home, i have overstayed longer than not. I have 5 children all born in UK from the ages of 7 to 10 months old. I do not have any clear cut evidence like bills or bank statements to show that i have been in Uk since all i have going back to 1993 are hospital records. Can i apply for ILR on long residents also is their a rule for a child born in UK and is now 7 years old. The father of my children who is now an ex partner is not a British national. What can i do to get ILR PLEASE HELP ME.

Hi - yes, you could make an application under both the 14 year rule and the 6 year child concession.

Can you give me some more information?

Where are you from?

How old are your children?

What is their father's nationality?

Have you ever claimed asylum, or been served with a refusal notice?

What is your immigration history?

How do you support yourself (work-wise)? Have you ever claimed any benefits?

Hi - based on that information, you should make an application under both the 14 year rule AND the 7 year child concession. Good chances of success, assuming neither of you has criminal convictions or has used false identities, etc
