Spouse Visa help

Post by assad786786 » Wed Sep 03, 2014 10:23 am

Hi, I came to UK in July 2010 on student visa and I got married to a british citizen in Dec 2013 but she had a job of 13,100 per annum and she has started a part time job in July 2014 to meet the minimum threshold income of 18,600 but I have to wait till Jan 2015 for 6 months to complete and my visa is expiring in Oct 2014. What is the best way so I wont go back to my country and apply for visa from here in Jan 2015?

You will be refused the spouse visa if you overstay, it would be best to return home and apply.
Flr(fp) application.

Applied - 29/07-14
HO Received - 31/07/14
Biometrics done - 12/08/14
Decision - Granted - 10/10/2014

Thanks for reply. I dont want to overstay but looking for a way to get some extension till Jan 2015? If I submit my application before my visa expires, will they put my visa on hold? If they do then later in Jan 2015 I will ask them to return my application so I could apply again.

Following the recent judgement, applications which fail to meet the financial condition are no longer being put on hold, they are simply being refused. Do you have no income?

No, I'm not allowed to work. Any other way to get extension of 3 months?

Not unless you can extend your student visa. Why haven't you been allowed the 20 hours per week as a student?

Urgent FLR M

Post by assad786786 » Thu Jan 08, 2015 8:36 pm

Hi, I have already applied for FLR FP and it has been over 3 months now I have not got the decision yet but I don't think I'm going to get visa on the basis of FLR FP so now I want to apply for FLR M. My wife has got 2 jobs since July 2014 accumulating £18900 pa. One of her job is paid in cash which has been going into her account but on the 1st of October the national minimum rate changed and she wasn't notified until she received the payslip from the accountant by post 2 weeks later and she put £1000 instead of £1012 in the month of October. The correct amount has been going into her account after that.

I have 2 questions.

1. Will my visa get refused on the basis of this?
2. Can I submit my application in person to get quick decision?

Thanks

It is quicker to vary the application by post and pay nothing.

If your book a PEO, it is likely a decision may be made before your appointment, and if it is negative, you will not be able to make a new application until your Section 3C right lapses.

The worst scenerio is, you may lose your booking fees.

Thanks for the reply. I will vary my application.

And I also want to know the answer of my other question of paying 12 pounds less in the account in the month of October?

Thanks

They will only consider what was paid into the account.

Yes, but on the payslip it says net amount £1012 but she put only £1000 in the account. Will my visa get refused on this?

Can you not speak to payroll directly and request this?

I spoke to payroll but they could only provide me 1 wage slip because they said they have deleted last year's data from the system. So I have got 5 months of wage slips from April to August plus employment history of 2 years and I have to apply before 22nd of September so cant wait for the September wage slip.
