my daughters visa

Hello everyone
I am inquiring about resident visa for my daughter who is currently in Botswana , southern Africa,i have a LTR and married and we want my daughter to join us in the UK.We put the application for her visa in October 2014 and it was refused in February this year on silly reasons that our immigration lawyer(ICS legal services) told us werent justified and should have no problem on getting the decision overturned on appeal.Nearly 6months on of filing the appeal we are still no closer to the appeal being heard.
We ring the appeal office every week and we get nowhere at all and still no hearing date, they keep on saying Pretoria Embassy in south Africa where i submitted the application in the first place hasnt got back to them,but the final date of the appeal was on the 9th of June 2015.
what do you think we should do?
1. wait for the appeal to be heard
2. Do a fresh application.

What were the reasons for refusal?

When you say you have LTR, are you on a spouse visa (i.e. is your spouse British or has ILR)?

How old is the daughter?

Who does she live with in Botswana?

Do you have sole responsibility and the proof that you have it?

Did you apply for a child settlement visa (VAF4A from) or some other visa?

The reasons for refusal they were saying the biological father is not on the birth cerficate, secondly, and they wil not take my wages into consideration, and they have been saying since i came into the UK i never invited her to visit me. Currently my 9year old daughter is living with the grandmother, and they insisted that she can be cared for while living with grandmother.my husband is british, i have a spousal visa.im the one who is providing for as always have done and submitted all the proof of all the documents to show ive been sending money,and the biological signed the affidavit/sworn statement saying he is happy for his daughter to live in the UK with me and my husband. I have applied for a settlement visa/family visa for her.
