Financial requirements for "nuclear families"???

Post by Emmie1980 » Wed Sep 09, 2015 3:57 am

Hello all,
Something just occurred to me and I really need some guidance.

My husband and I both have children from previous relationships. My husband's two children are UK born and are residing with their mother. I should also add that my husband and his ex partner have an amicable relationship and have worked all the children related issues including visitation and child support without the help of Family Court. Basically, there is no court order related to the visitation and child support.

I have a daughter from a previous relationship and have just won the right to move to the UK with her from Canada.

My question is this: Will the financial requirement for the UK spouse visa be increased because my husband has two UK born children even though they are not residing with him? Will any other requirements be affected?
Should I mention my step children while applying for the spouse visa?

Thank you so much for your help!

Emmie:)

Your step-children won't be included in the financial calculation, but your daughter will.
As you probably know, your husband will have to show annual income in the UK of at least £22,400, unless you have savings over £16,000 to make up any shortfall. I believe the application form asks if your husband has any dependants.
Is your husband currently in the UK?

Thank you so much for your answer. Yes, my husband has always been in the UK and we are aware of the 22,400 financial requirement. The Visa application only asks me if I have any dependent or non dependent children, but they don't ask that about my husband.

Again, thank you. You have put my mind at ease :D

Are you step-children either British citizens or "settled in the UK" (on ILR or PR)? I presume that they are British citizens.

British citizen children are not included in the financial requirements calculations anyway.

Yes, my step children are British born and are British citizens. I thought that was the case, but I just wanted to make sure.
Thank you for you answer:)
