Bk in UK from Ireland...LAST STEP Help

Just to make sure is it the EEA FM 91 pages the right form? everyone saying 100 + pages but i only see the 91 page document here for surinder Singh cases. https://www.gov.uk/government/publicati ... orm-eea-fm

we plan to apply, also it states integration into EEA Country and example is child born there....my wife got pregnant there but she is due in dec she gone through most the pregnancy in Ireland do you think that will help with the centre of life test or would it possibly go against us as we moved to uk for her to give birth here?

if the application is refused on surrinder singh cases can you appeal and how often do people get refused? she has 5 months left on her family permit and want to apply for the uk residence card soon and i cant afford for it to go wrong with a child on the way

As far as I understand, your wife's UK RC application under SS criteria will be wholly based on your time spent in Ireland. As you are already back in UK, there seems no point in pondering over what will happen if this happens or that happens. You cannot now turn back the clock and do or undo something that happened in past ie during your stay in Ireland.

Just apply with all the proofs you have gathered in Ireland. :idea:

In the unlikely case there is a refusal, you will have a right of appeal.

thats great, thanks for the reply, we do plan to go back to ireland in 2 weeks to collect the residence card would it be wise to wait to get this before we apply (as the uk would have our passports?) also i heard it takes 6 months for them to make a decision what happens with my wife as she only has 5 months left on her family permit is she entitled to stay until decision is made? do they stamp passport or something? to extend the time or do they make a decision before family permit expires anyway

and is a refusal unlikely??? also is that the correct link above to the application form? 91 pages? what pages apply to the SS Route?

Hey Robster,
Apparently they are really busy with a lot of backlogs, my husbands letter is now. Weeks over, have sent them emails no respond. Hopefully we get the letter before the end of September because we are heading bk to the UK early October. His temp stamp expires 2/10

Am just letting u know so that you are not shocked or alarmed if u don't hear bk by the ur due date.

With regards to the form, it's the correct form. If you read it carefully and follow the steps you will know which part applies to you. If you are really concerned then you can use a lawyer.

Your questions to the questions determines the next step so I don't think anyone can categorically tell u, go to page 2 dats for SS route. You just have to read it n answer the questions. It's pretty straight forward

sounds like the same as ireland a back log, when did you apply for your uk residence card? and how many weeks over was the letter sent? , thanks for the heads up, yeah we have exactly 5 months today left on my wifes FP visa.

let me know if your application is successful, what did u use for the centre of life test for paper work? do you think be worth showing our doctors appointments for my wifes pregnancy for this? she got pregnant while we were there and had at least 6 months of pregnancy while we were there, we planned to stay in ireland longer but i wanted to move back asap so my wife could be with my mum not alone while i was working

We are still in Dublin, still waiting for my husbands five yrs letter before we leave. They replied my email today, they are reviewing our application now and will get bk to us soon. So hopefully by the end of this week or next week we will get the reply.

yeah good luck I'm sure it be fine! we were going to do the same but because my wife was pregnant i had to get her back to my parents asap as life got to tough in ireland, our plan is to come back to collect the residence card, thing is this, do we apply for uk residence now? can we get our passports back off them straight away so we can return to ireland (once the approval letter arrives here to uk thru our mail re-direction) or do we wait go back to ireland in a month get the 5yr card come back then apply for her to remain in the uk? thing is i rather get uk application sent sooner rather then later its just the passport aspect that worrys me can we get them back from the home office quickly if we sent them off this week?, ireland visa expires 26 oct so not much time really, some advise on what order we should do things would be great, does uk immigration need the passports for whole time the application is with them? and does it matter how quickly u apply within the uk to remain?

Hi Robster,
Just wanted to let you know, the final stage before the five yrs letter is issued, inis will call the employer to verify employment. I guess this is just another way to frustrate applicants.
Another board member told me her employer was called this week to verify her employment. Her decision date is the 9th and she hasn't heard from them.
I work for a big company and wouldn't know if they have contacted my HR dept but the last letter we got they requested my employers Irish phone number.
I just though to give u the heads up.
